Wir kommen nun zu Traktandum 9: Übereinkommen über die Beteiligung der Tschechischen Republik, der Republik Estland, der Republik Zypern, der Republik Lettland, der Republik Litauen, der Republik Ungarn, der Republik Malta, der Republik Polen, der Republik Slowenien und der Slowakischen Republik am Europäischen Wirtschaftsraum betreffend das EWR-Erweiterungsabkommen vom 14. Oktober 2003. Der Bericht und Antrag der Regierung Nr. 2/2004 steht zur Diskussion.Abg. Jürgen Zech:
Herr Präsident, geschätzte Damen und Herren Abgeordnete. Am 1. Mai 2004 wird die Europäische Union und damit der EU-Binnenmarkt durch 10 neue Mitgliedstaaten erweitert werden. Dies hat natürlich auch direkte Auswirkungen auf das EWR-Abkommen. Art. 128 EWR-A sieht ausdrücklich vor, dass die Homogenität des Europäischen Wirtschaftsraumes mit den entsprechenden Binnenmarktbestimmungen unbedingt zu gewährleisten ist. Aus diesem Grunde ist eine parallele Erweiterung der EWR-Mitgliedschaft um die 10 neuen EU-Mitglieder unabdingbar. Durch diese Erweiterung wächst die Anzahl Einwohner im EWR von heute über 380 Millionen auf neu gut 455 Millionen. Was ich an dieser Stelle noch erwähnen möchte, ist, dass mit 8 der 10 EWR- und EU-Neumitglieder bereits EFTA-Freihandelsabkommen bestehen. Noch im Dezember 2002, unmittelbar nach Aushandlung der Formalitäten des EU-Beitritts, reichten alle 10 Beitrittsländer ihre Anträge um Aufnahme in den EWR gemäss Art. 128 EWR-A ein. Die Beitrittsverhandlungen begannen offiziell im Januar 2003. Das Abkommen und die Schlussakte tragen das Datum 14. Oktober 2003. Liechtenstein hat das Abkommen aufgrund der bestehenden offenen Fragen im Verhältnis zu Tschechien und zur Slowakei erst am 11. November 2003 unterzeichnet, zusammen mit unseren beiden EFTA/EWR-Partnern Island und Norwegen. Italien als EU-Vorsitzland und die EU-Kommission unterzeichneten ebenfalls an diesem Datum. Alle beteiligten Staaten müssen nun dem EWR-Erweiterungsabkommen zustimmen. Das Erweiterungsabkommen sieht in Analogie zum EU-Beitrittsvertrag eine Reihe von Sonder- und Übergangsbestimmungen für die Integration der 10 neuen Mitgliedsländer in den Binnenmarkt vor. Auch für Liechtenstein, Island und Norwegen, die nicht Vertragsparteien des EU-Beitrittsvertrages sind, sieht das EWR-Erweiterungsabkommen spezifische Bestimmungen vor. Liechtenstein war es im Zuge der Verhandlungen möglich, seine im Rahmen des EWR bereits bestehende Sonderlösung beim Personenverkehr zu verlängern. Gemäss dieser Sonderregelung kann Liechtenstein weiterhin den Zuzug von EWR-Staatsangehörigen mittels Quotenregelung begrenzen. Die Quotenregelung besagt, dass mindestens 56 erwerbstätigen und 16 nicht-erwerbstätigen EWR-Staatsangehörigen pro Jahr, davon 50% im chancengleichen Auslosungsverfahren, der Zuzug nach Liechtenstein zu gewähren ist. Darüber hinaus konnte die zeitliche Begrenzung der Sonderlösung durch eine verlängerte und auf Dauer angelegte Lösung ersetzt werden. Andererseits werden die Beitragszahlungen der drei EFTA-/EWR-Staaten auf das Fünffache der bisherigen Beträge steigen, somit befristet auf 5 Jahre von Mai 2004 bis April 2009. Für Liechtenstein heisst das, rund CHF 1,5 Mio. pro Jahr bis 2009. Am Ende der Beitragsverpflichtung überprüfen die Vertragsparteien, ob aufgrund von wirtschaftlichen und sozialen Ungleichheiten im EWR weiterhin Unterstützungsbeiträge notwendig sein werden. Wie die Regierung, bewerte auch ich das EWR-Erweiterungsabkommen aus politischer und wirtschaftlicher Sicht als grundsätzlich positiv. Das weitere Zusammenwachsen Europas verstärkt den gemeinsamen Dialog und ist somit eine wichtige Grundlage für den Frieden in Europa. Aus wirtschaftlicher Sicht stärkt der erweiterte EWR die Chancen für die liechtensteinische Exportindustrie und er wird auch im Dienstleistungsbereich erlauben, neue Märkte zu erschliessen. Diese Möglichkeiten gilt es nun von der Privatwirtschaft zu nutzen. Eine Kehrseite der Medaille wird meiner Meinung nach wahrscheinlich der vermehrte Druck auf dem liechtensteinischen Arbeitsmarkt sein, verursacht durch die billigeren Temporärarbeitskräfte. Diesem Wettbewerb können wir uns nicht entziehen. Durch unseren EWR-Beitritt am 1. Mai 1995 nach der Volksabstimmung pro EWR haben wir uns diesem Wettbewerb gestellt und die Herausforderung angenommen, uns in diesem dynamischen Markt zu behaupten, der nicht nur Vorteile, sondern - wie jeder Vertrag - naturgemäss auch Nachteile mit sich bringt. Ich werde dem Antrag der Regierung Folge leisten und dem EWR-Erweiterungsabkommen vom 14. Oktober 2003 mit den Anhängen A und B, der Schlussakte vom 14. Oktober 2003 zum EWR-Erweiterungsabkommen und dem Finanzbeschluss betreffend den Anteil Liechtensteins am EWR-Finanzmechanismus für die Jahre 2004 bis 2009 im Gesamtbetrag von EURO 4,5 Mio. - oder CHF 7,2 Mio. - meine Zustimmung erteilen. Landtagsvizepräsident Peter Wolff:
Herr Präsident. Es scheint mir selbstverständlich zu sein, dass diesem EWR-Erweiterungsabkommen zugestimmt wird. Es war schon beim Abschluss des EWR-Abkommens im Jahr 1992 und bei der späteren Ratifikation desselben und Annahme durch das Volk klar, dass zukünftige allfällige EU-Beitrittsländer, die also der EU beitreten würden, auch Antrag auf Beitritt zum EWR stellen werden, so wie es im EWR-Vertrag vorgesehen ist. Es kann nicht ernsthaft erwogen werden, einem Beitritt eines solchen neuen EU-Mitgliedslandes zum EWR die Zustimmung zu verweigern, ausser wenn im Einzelfall sehr schwer wiegende Gründe dagegen sprechen würden, was hier nicht der Fall ist.Ich finde es begrüssenswert, dass im Rahmen dieser EWR-Beitrittsgespräche nicht nur die Formalien eines solchen Beitritts abgehandelt wurden, sondern dass auch die für Liechtenstein besonders wichtige Personenverkehrsproblematik angesprochen wurde, die ja dadurch eine gewisse zusätzliche Brisanz erhält, als nicht nur weitere Millionen an Europäerinnen und Europäern aus den neuen Beitrittsstaaten ebenfalls in den rechtlichen Rang von EWR-Bürgern kommen und dadurch erleichterte Einreise- und Arbeitsmöglichkeiten in der Zukunft geniessen werden, sondern - wie wir wissen -, dass diese Leute auch aus Staaten kommen, wo teilweise zumindest angenommen oder befürchtet wird, dass der Druck in Staaten in denen eher Arbeit zu finden ist und mehr Geld zu verdienen ist, besonders gross sein wird. Die Regierung hat hier in diesem Zusammenhang eine signifikant abgeänderte Personenverkehrslösung ausgehandelt, wie sie im Anhang B zu dem Erweiterungsabkommen auf Seite 11 nachgelesen werden kann. Ich finde es sehr gut, dass in Fortsetzung der auch schon von früheren Regierungen sehr erfolgreich in diesem Thema verhandelten Lösungen hier nochmals ausgebaut werden konnten. Der grosse Vorteil - wie wir wissen - wird sein, dass es zukünftig nicht mehr auf das einseitige Wohlwollen der EU-Staaten und der EU selbst ankommen wird, ob eine befristete Sonderlösung in Fragen des Personenverkehrs nach Ablauf einer gewissen Frist verlängert wird oder nicht, sondern jetzt wird es auch auf unsere Zustimmung ankommen, ob allenfalls eine solche Lösung nicht verlängert wird. Mit anderen Worten: Wir haben es selbst in der Hand, mit darüber zu entscheiden und unsere Zustimmung wür-de notwendig sein, wenn die an und für sich vom Inhalt her unveränderte Personenverkehrsregelung zukünftig einmal eingeschränkt oder überhaupt in Frage gestellt werden sollte. Wohl wird diese Lösung alle 5 Jahre einem Review unterzogen werden, also überprüft werden, wie die Voraussetzungen in Liechtenstein sind, aber sie läuft an und für sich auf unbestimmte Zeit weiter, jetzt nach dieser neuen Regelung so lange weiter, bis der gemeinsame EWR-Ausschuss einmal mit Zustimmung Liechtensteins beschliessen sollte, dass eine solche Lösung nicht mehr notwendig ist.Ich habe in diesem Zusammenhang eine Frage an die Regierung, vielleicht eine als rhetorisch empfundene Frage, aber ich kann mich nicht erinnern, dass in der Medienberichterstattung zu diesem Thema bisher davon die Rede war: Auf den Seiten 26 unten und 27 des Berichtes lesen wir, dass die Übergangsfrist, die im Erweiterungsvertrag für die Angehörigen der Beitrittsstaaten von zunächst 2 Jahren vorgesehen ist - allenfalls dann sogar verlängert um weitere 3 oder in Extremfällen sogar nochmals um weitere 2 Jahre -, dass diese Übergangsfrist nur für Arbeitnehmer gilt, nicht aber für selbstständig Erwerbstätige oder für nicht erwerbstätige Personen. Mit anderen Worten: Für selbstständige und für nicht erwerbstätige Personen gilt der volle EWR-Acquis ab sofort ohne Übergangsfrist, sodass diese daher auch fremdenpolizeirechtlich ab sofort wie die Bürger der bisherigen EWR-Staaten zu behandeln sind. Wörtlich heisst es da in diesem Zusammenhang auf Seite 27 oben des Berichtes - ich zitiere: «Die Errichtung einer geschäftlichen Niederlassung, der grenzüberschreitende Dienstleistungsverkehr sowie die erwerbslose Wohnsitznahme können nicht beschränkt werden», also bezogen auf die Übergangsfrist. Ich möchte doch der Verdeutlichung halber die Regierung fragen, ob es richtig ist, dass diese Ausführungen, die hier ja als Zitat aus dem EU-Beitrittsvertrag gebracht werden, dass diese mit In-Kraft-Treten des EWR-Beitrittsabkommens auch für Liechtenstein in Kraft treten, sodass diese Voraussetzungen für die Angehörigen der neuen 10 Beitrittsstaaten daher dann ab sofort auch in Liechtenstein gegeben sind.Als wohltuend habe ich es empfunden, dass das im Herbst noch so heiss umstrittene Thema der zunächst nicht erfolgten Unterzeichnung dieses EWR-Beitrittsabkommens bzw. Erweiterungsabkommens durch Liechtenstein in diesem Bericht in einer doch sehr - ich würde mal sagen - abgeklärten und sachlichen Art und Weise aufbereitet wird, und vor allem erstmals in einem der Öffentlichkeit zugänglichen Bericht all die Erklärungen der Tschechischen Republik, der Slowakischen Republik und unseres eigenen Landes im Wortlaut abgedruckt sind, die in chronologischer Reihenfolge im Laufe des letzten Jahres vor dem ursprünglich vorgesehenen Unterzeichnungsdatum 14. Oktober 2003 gewechselt wurden. Interessanterweise - und auch das wird in einer sachlich ruhigen Art dargestellt - interessanterweise schliesst die Regierung selbst - die meiner Erinnerung nach in der zweiten Oktoberhälfte letzten Jahres zumindest in Medienveröffentlichungen noch ganz andere Aussagen gemacht hat - schliesst die Regierung selbst aus diesen ursprünglich paraphierten Erklärungen der Tschechischen und Slowakischen Republiken am 3. Juli 2003, wie wir auf Seite 43 oben nachlesen können, dass somit - ich zitiere - «anerkennt somit die Tschechische Republik das Fürstentum Liechtenstein als souveränen Staat». Das geht an und für sich auch klar aus dem Text dieser beiden Erklärungen hervor, die, wie gesagt, bei der Paraphierung als vorgesehener Bestandteil der Schlussakte beigefügt wurden und dort auch beigefügt geblieben wären, wenn Liechtenstein dann im Laufe des Herbstes nicht zusätzliche Vorstellungen über den Inhalt solcher Erklärungen entwickelt hätte. In der diesbezüglichen Erklärung der Tschechischen Republik heisst es nämlich - siehe Seite 41 unten - ich zitiere: «Die Tschechische Republik erklärt, dass auch sie das Fürstentum Liechtenstein als souveränen Staat anerkennt» und in der Erklärung der Slowakischen Republik heisst es dazu auf Seite 42: «Seit ihrer Gründung anerkennt die Slowakische Republik das Fürstentum Liechtenstein als souveränen und unabhängigen Staat an und ist bereit, diplomatische Beziehungen mit dem Fürstentum aufzunehmen». Ich erwähne das nur deshalb noch einmal - für jemanden, der sich seit Jahren intensiv mit diesem Thema beschäftigt hat, ist es ja keine Überraschung, das ist an und für sich eine Selbstverständlichkeit - aber ich erwähne es doch deshalb noch einmal, weil in der öffentlichen Diskussion unmittelbar nach dem 14. Oktober 2003 in einer den tatsächlichen Sachverhalt - wie ich meine - etwas verfälschenden Art und Weise der Eindruck erweckt wurde, als ob die Tschechische und Slowakische Republik grundsätzlich es abgelehnt hätten, anzuerkennen, dass Liechtenstein ein souveräner Staat sei, und um diesen unakzeptablen Zustand zu vermeiden, habe man von der Unterzeichnung des Abkommens Abstand nehmen müssen. So damals die Verlautbarungen der Regierung. Heute lesen wir übrigens in diesem Zusammenhang interessanterweise - und das ist mir neu, dass das die Ansicht der Regierung damals schon war - heute lesen wir auf Seite 50 im 2. Absatz: «Die Regierung war sich bei diesem gewählten Vorgehen» - gemeint ist die Nicht-Unterzeichnung am 14.10.2003 - «bewusst, dass angesichts der politischen und wirtschaftlichen Bedeutung des EWR-Erweiterungsabkommens und damit schliesslich des EWR insgesamt nur ein relativ beschränktes zeitliches Fenster für die Suche nach einer Lösung verblieb». Auch das ist, wie ich meine, eine etwas euphemistische Aussage, denn wenn sich die Regierung dieses Umstandes schon bewusst war und wie man aus diesem Satz schliessen kann, offenbar ihr damals schon klar war, dass man nur für eine gewisse kurze Frist diese Unterzeichnung des Erweiterungsabkommens hinausschieben könne, dann hätte man sich damals wohl auch denken können, dass im Hinblick auf die schon 12 Jahre andauernde intransigente Haltung der Tschechischen Republik wohl kaum innert 2 bis 3 Wochen plötzlich mit einem Einschwenken dieser beiden Staaten auf unsere Wünsche nach einer rückwirkenden Anerkennung der Souveränität - wenn möglich bis zum Jahr 1806 - zu rechnen sein werde. Die Regierung schreibt zwar auch in diesem Bericht und Antrag an anderer Stelle, dass es nützlich gewesen sei, diese Unterzeichnung anfänglich zu verweigern. Auf Seite 53 heisst es dazu im 4. Absatz, allerdings ohne nähere Begründung, wie die Regierung zu dieser Auffassung kommt, ich zitiere: «Die Position Liechtensteins wurde mit dem dargestellten Vorgehen gestärkt, gerade auch wegen der vorläufigen Nicht-Unterzeichnung des EWR-Erweiterungsabkommens, und zwar sowohl innerhalb der EFTA-/EWR-Staaten gegenüber der EU wie auch im bilateralen Verhältnis zur Tschechischen und zur Slowakischen Republik». Ich glaube zwar nicht, dass die Position Liechtensteins rückblickend betrachtet durch die anfängliche Nicht-Unterzeichnung geschwächt wurde, allerdings nur deshalb nicht, weil man diese auf Dauer unhaltbare Position sehr rasch wieder aufgegeben hat. Warum die Position gestärkt worden sein soll, ist also bei nüchterner Betrachtung der Dinge beim besten Willen nicht erkennbar. Aber das nur als Anmerkung im Nachhinein, weil das damals vorübergehend eine gewisse - ich würde mal sagen - Eigendynamik angenommen hatte und man 1, 2 Wochen lang glauben konnte, das sei das wichtigste Thema, das es in Liechtenstein überhaupt gibt. Diese Haltung hat sich schon längst verflüchtigt und auch - wie ich schon gesagt habe - die nüchterne und den Sachverhalt objektiv nachvollziehende Darstellung in diesem Bericht und Antrag zeugt davon, dass auch die Regierung hier in der Zwischenzeit zu einer - wie ich meine - vernünftigen Einstellung zurückgefunden hat.Ich glaube daher, dass es ohne Vorbehalt richtig ist, diesem Antrag der Regierung auf Zustimmung zu diesem EWR-Erweiterungsabkommen - ebenso wie zu dem Finanzbeschluss - zuzustimmen, natürlich auch der Schlussakte zu diesem EWR-Erweiterungsabkommen, und wünsche, nicht nur dieser Regierung, sondern überhaupt dem Fürstentum Liechtenstein, dass es tatsächlich in absehbarer Zeit einmal zu einer Lösung welcher Art auch immer des seltsamen - würde ich einmal sagen - des völkerrechtlich seltsamen Verhältnisses zur Tschechischen und zur Slowakischen Republik kommen möge. Worin diese Lösung liegen soll, darüber will ich mich hier nicht prophetisch verbreiten. Vielleicht fällt irgendeinem unserer jetzigen oder zukünftigen Politiker hier einmal der Stein des Weisen ein.Abg. Ingrid Hassler-Gerner:
Wenn am 1. Mai dieses Jahres der EU-Binnenmarkt um 10 weitere, um 10 neue Mitgliedstaaten erweitert wird, ist auch eine parallele Erweiterung der EWR-Mitgliedschaft eine Voraussetzung. Dieses Erweiterungsabkommen - wie auch der EU-Beitrittsvertrag - sieht allerdings einige Sonder- und Übergangsbestimmungen vor. Zudem steht für unser Land der Verfünffachung der Beitragszahlungen auf jährlich rund CHF 1,5 Mio. auch eine substanziell wichtige rechtlich besser verankerte Sonderlösung im freien Personenverkehr gegenüber. Ich habe nochmals die 16 Punkte der Präambel gelesen, die das Abkommen über den Europäischen Wirtschaftsraum vom 2. Mai 1992, dem das Liechtensteiner Volk zweimal zugestimmt hat, einleitet. Sie sind nicht nur lesenswert, sondern zeigen den ganzen Gehalt dieses grossen Vertragswerkes, mit dem man die europäische Friedensordnung erweitert und ein weiteres Zeichen der Solidarität setzt. In Anbetracht der in der Präambel deklarierten Grundsätze und mit den Erfahrungen, die Liechtenstein seit dem In-Kraft-Treten am 1. Mai 1995 unter dem Strich gemacht hat, ist die Einbindung unseres Landes ein Gewinn. Trotzdem bleiben die EU in ihrer eigenen Ausgestaltung und die im EWR verbundenen Staaten Europas eine dauernde Herausforderung. Die Erweiterung des Binnenmarktes, primär gegen den Osten Europas, eröffnet in wirtschaftlicher Hinsicht der Exportindustrie und auch unserem Finanzdienstleistungssektor neue Absatzmärkte. Das ist oder wird auch noch eine Frage des Wettbewerbs werden. Im Weiteren konzentriere ich mich ergänzend zu den beiden Vorrednern auf die wirtschaftliche Dimension und deren Integration in dieses umfassende Abkommen. Im Kapitel 7 des Berichtes und Antrages wird der Versuch gemacht, die wirtschaftlichen Vor- und Nachteile dieser EWR-Erweiterung für Liechtenstein darzustellen. Die neuen Mitgliedstaaten werden höhere Raten in ihrem Wirtschaftswachstum und ein Wirtschaftspotenzial, das es von der Privatwirtschaft zu nutzen gelte, aufweisen. Andererseits geht eine österreichische Studie für den gesamten EU-Raum von einer Erhöhung der Wertschöpfung von 5% aus. Ausser durch tendenziell grösseres Wachstum werde sich die neue EU aber auch durch mehr Arbeitslose charakterisieren. In monitärer Hinsicht werden vorerst keine Komplikationen erwartet, weil diese neuen EU-Länder bis zur Aufnahme in die Europäische Währungsunion für ihre Geldpolitik selbst verantwortlich bleiben. Nicht erwähnt wird dabei der durch unterschiedliche Steuersysteme und Steuersätze anzukurbelnde Steuerwettbewerb. Ich möchte hier S.D. Prinz Nikolaus aus einem Interview zitieren und bei dieser Gelegenheit ihm und seinem Verhandlungsteam herzlich danken für die Arbeit zu diesem Vertragswerk. Ich zitiere: «Die neuen EU-Länder haben teilweise interessante Steuersysteme, welche die alten EU-Länder zwingen, darauf zu reagieren. Das wird man nicht so leicht über eine Steuerharmonisierung erreichen, wenn diese Länder in der EU sind. Damit entsteht auch für Liechtenstein eine veränderte Wettbewerbssituation, denn so lange die Slowakei eine einzige Steuerrate von 19% kennt, ist selbst unser Tiefsteuerland herausgefordert. Möglicherweise wird dieser Steuerwettbewerb Europa mehr bringen als die Absatzmärkte, denn damit werden die Staaten gezwungen, schlanker zu werden, mit dem Ergebnis, dass Europa konkurrenzfähiger wird». Die Regierung erwartet gemäss dem vorgelegten Bericht wenig Probleme bei der Integration der neuen Mitglieder in den EWR, vorausgesetzt sie erfüllen die mit der EU-Mitgliedschaft verbundenen Bedingungen. Andererseits schliesst sie einen gewissen Druck auf die liechtensteinische Wirtschaft nicht aus, was allerdings nicht quantifizierbar sei. Die spezifische Personenverkehrslösung für unser Land und die auf die ersten paar Jahre laufenden Übergangsfristen sollten gemäss Regierung unseren Arbeitsmarkt vor einem massiven Druck schützen. Dennoch erwartet sie, dass die neuen Mitgliedstaaten längerfristig Bewegungen und Umschichtungen auf dem liechtensteinischen Arbeitsmarkt verursachen werden. Dazu kommt, dass bereits während der Übergangsfristen Staatsangehörigen der neuen EWR-Mitglieder über die Erteilung einer Grenzgängerbewilligung bei entsprechender Ausbildung und Berufserfahrung der Zugang zum Arbeitsmarkt gewährt werden kann, wenn die Nachfrage seitens der liechtensteinischen Wirtschaft gegeben sein sollte. Das ist bei Wohnsitzname im grenznahen EU-Ausland also durchaus möglich.Die geschäftliche Niederlassung in Liechtenstein, also die Gründung auch einer Firma, ist mit Beginn dieser Erweiterung ohne Wohnsitzname in Liechtenstein möglich. Auch für die grenzüberschreitende Dienstleistungserbringung werden Personen aus diesen 10 neuen Mitgliedstaaten den heutigen EWR-Staatsangehörigen gleichgestellt. Die Regierung versprach auf Anfrage in der Aussenpolitischen Kommission vom 1. März, meine Frage näher zu beleuchten, ob es kritische Branchen oder Bereiche gibt, welche einem erhöhten oder besonderen Anpassungsbedarf ausgesetzt sein könnten. Ich nehme an, der Herr Regierungsrat ist darauf vorbereitet.Mein Schlussgedanke neigt sich mehr gegen den Westen, an unseren Nachbarn Schweiz. «Es bedarf keiner Anpassung, weder unsererseits mit der Schweiz noch seitens der neuen EWR-Partner», schreibt die Regierung. Hier möchte ich lediglich bestätigt erhalten, dass dies alles so einfach ist, wie es die Regierung im Kapitel 2.4 ausführt. Allenfalls gibt es dazu noch zusätzlich Ausführungen, zumal die Schweiz bezüglich der Personenfreizügigkeit die auf alle neuen 25 EU-Länder ausgeweiteten so genannten «Bilaterale II» unter Einschluss von Abkommen der Zinsertragsbesteuerung zum so genannten Abgabenbetrug und dem nicht unproblematischen Schengen-/Dublin-Acquis und die im Regierungsbericht nicht erwähnte Betrugsbekämpfung noch nicht abschliessend verhandelt ist. Dem zur Ratifikation uns vorgelegten Übereinkommen vom 14. Oktober 2003 samt Anhängen zur EWR-Erweiterung und dem damit unweigerlich verbundenen Finanzbeschluss erteile ich meine Zustimmung.Abg. Alois Beck:
Ich möchte nur noch kurz auf das Votum des Landtagsvizepräsidenten eingehen: Ich möchte auch, wie er schon festgestellt hat, die jetzt wesentlich sachlichere Diskussion bezüglich der Verzögerung bei der Unterzeichnung hervorheben. Die Passagen, die der Landtagsvizepräsident zum Teil zitiert hat, stimmen. Aber wenn ich das noch recht in Erinnerung habe, war das eben immer so, dass zwar die Tschechische und die Slowakische Republik die Souveränität von Liechtenstein anerkannt haben, aber wenn dann nur eingeschränkt. Es war nicht eine integrale und war immer an gewisse Bedingungen geknüpft. Und hier stellt sich natürlich dann immer die Frage aus Sicht unseres souveränen Landes, ob man das tolerieren kann und will oder nicht. Die Passage auf Seite 53, die er ebenfalls zitiert hat, wo die Regierung schreibt: «womit die Position Liechtensteins gestärkt wurde». Diese Ansicht teile ich. Der Landtagsvizepräsident hat ausgeführt, dass die liechtensteinische Position nicht geschwächt wurde. Wenn man in Erinnerung ruft, was im letzten Herbst zu diesen Dingen ausgesagt wurde, ist das sicher beachtenswert. Ich möchte aber doch kurz ausführen, weshalb ich auch der Meinung bin, weshalb die Position Liechtensteins gestärkt wurde. Es heisst hier, dass diese Position sowohl innerhalb der EFTA-/EWR-Staaten gegenüber der EU wie auch im bilateralen Verhältnis zur Tschechischen Republik und zur Slowakischen Republik gestärkt wurde. Als kleines, verletzliches Staatsgebilde ist die Souveränität halt immer wieder ein Thema. Und als Mikrostaaten - oder wie immer man das auch bezeichnen will - muss man eben das immer auch entsprechend deponieren. Wir können nicht davon ausgehen, dass alle das immer so zur Kenntnis nehmen und müssen hier eben unsere Position dauernd einbringen. Und dieses internationale Verständnis, glaube ich, wurde durch dieses Vorgehen eindeutig und klar geweckt. Offensichtlich war es bei unseren EFTA-/EWR-Partnern, die in guter Solidarität unsere Haltung unterstützt haben, das nicht nur in dem Sinne rhetorisch, sondern eben auch durch praktische Handlungen und Taten, durch ihren Einsatz, wofür ihnen auch gedankt ist. Generell konnte eben das Problembewusstsein einer breiteren und wirklich internationalen Öffentlichkeit auch bewusst gemacht werden. Ich bin auch überzeugt, dass das gegenüber der EU der Fall ist und ich konnte nie den Medien entnehmen von diesen Staaten oder von der Kommission, dass hier gegenüber dem Vorgehen Liechtensteins wirklich ein Vorbehalt gemacht worden wäre. Wir müssen uns auch daran erinnern, dass auch innerhalb der EU beim Beitritt der Tschechischen Republik eine ausführliche und intensive Debatte stattfand. Ich erinnere nur an die recht kontroversen Diskussionen im Europäischen Parlament, wo eben die Problematik der Benes-Dekrete klar auf dem Tisch lag. Und hier, glaube ich, auch von diesen Staaten und von der Kommission hat man deshalb sehr wohl ein grundsätzliches Verständnis für unser Anliegen und unser Vorgehen gehabt. Für mich ist ein Zeugnis dafür auch, dass sich EU-Kommissar Günter Verheugen explizit dafür eingesetzt hat. Ich glaube schliesslich auch, dass wir unsere Position gegenüber der Tschechischen Republik und der Slowakischen Republik insofern gestärkt haben, dass wir einer weiteren internationalen Öffentlichkeit unser berechtigtes Anliegen kundgemacht haben. Hier geht es um die Souveränitätsfrage. Ich kann mich nicht erinnern, dass man hier je eine grundsätzliche Kritik geerntet hat. Die Benes-Dekrete sind immer wieder ein Thema. Ich erinnere nur an einen kürzlichen Beschluss des Tschechischen Parlamentes, das mit einem eigenen Gesetz Eduard Benes für seine Verdienste für den Staat gewürdigt hat. Ich habe hier eine Zeitungsmeldung, wo es heisst - ich zitiere: «Für das Gesetz, das einzig aus dem Satz ‹Eduard Benes hat sich um den Staat verdient gemacht› besteht, stimmten 118 der insgesamt 183 Parlamentsabgeordneten». Nebenbei stellt sich hier natürlich die Frage, ob die kürzesten Gesetze auch immer die besten Gesetze sind. Aber das muss jeder selbst beurteilen.Mit diesem kurzen Seitenblick möchte ich eigentlich nur die grundsätzliche Thematik ansprechen und dass das nicht ein spezifisch liechtensteinisches Problem ist, sondern, dass es eben auch andere Staaten und Länder betrifft. Ich glaube, dass wir diesbezüglich sehr wohl nachhaltiges Verständnis geerntet haben. Und deshalb bin ich davon überzeugt, dass das gewählte Vorgehen eben die Position Liechtensteins nicht nur nicht geschwächt, sondern eben gestärkt hat.Landtagsvizepräsident Peter Wolff:
Es ist sehr interessant, was der Kollege Alois Beck da gerade aus dem Tschechischen Parlament berichtet hat, nämlich dass das Tschechische Parlament vor kurzem ein Gesetz zur Würdigung von Eduard Benes mit 118 von 183 Stimmen angenommen hat. Das sind nämlich genau 64,4% und das ist ein Prozentsatz, der mir von irgendwo her in Erinnerung ist. Das aber nur nebenbei.Ich habe mich hauptsächlich deshalb nochmals zu Wort gemeldet, um doch der Legendenbildung ein wenig entgegenzuwirken, die der Abg. Beck da wieder betreibt, nämlich Legendenbildung im Hinblick auf angeblich nur eingeschränkte oder nicht integrale Anerkennung oder Absicht der Anerkennung der Souveränität Liechtensteins durch die Tschechische und Slowakische Republik. Das stimmt einfach nicht, denn wenn Sie die beiden Erklärungen, wie sie für den Fall vorgesehen waren, dass Liechtenstein sich dann am 9. Oktober 2003 nicht quer gestellt hätte und wie sie hier auf den Seiten 41 und 42 des Berichtes und Antrages der Regierung korrekt wiedergegeben werden, lesen, dann werden Sie darin von einer eingeschränkten oder von einer nicht integralen Anerkennung unserer Souveränität gar nichts finden. Das Problem liegt doch ganz woanders. Die als Einzelstaaten neu gegründeten Tschechischen und Slowakischen Republiken wollten sich - und wollen sich heute noch - der peinlichen Frage nach der Richtigkeit und nach der Wirksamkeit des Liechtensteiner Staatsbürger betreffenden Benes-Dekretes aus dem Jahr 1945 dadurch entziehen, indem sie sagen: «Das geht uns nichts an, wir sind nicht der Rechtsnachfolger der damaligen Tschechoslowakei, wir sind erst um das Jahr 1991 herum gegründet worden. Selbstverständlich anerkennen wir das Fürstentum Liechtenstein als souveränen Staat ohne jedes Wenn und Aber, aber was früher war, damit könnt Ihr uns nicht behaften». Und Liechtenstein möchte natürlich verständlicherweise erreichen, dass diese beiden formalrechtlich neu entstandenen Staaten auch bestätigen, dass Liechtenstein natürlich nicht erst jetzt, sondern auch schon im Jahre 1938 - und übrigens schon seit dem Jahr 1806 - ein eigener, ein souveräner Staat war. Und daraus würden sich dann entsprechende Fragen im Zusammenhang mit diesem Benes-Dekret ergeben. Und das wollen die Tschechen und die Slowaken einfach nicht. Deshalb weichen sie dem aus und sagen: «Natürlich anerkennen wir eure Souveränität, aber was früher war, darüber wollen wir uns nicht behaften lassen». Eine kleine Nebenbemerkung noch zur Verdeutlichung: Bei der Anerkennung eines anderen Staates als Völkerrechtssubjekt - die im Übrigen, wie die Slowaken hier in ihrem damaligen Erklärungsentwurf selbst sehr richtig schreiben, nur integral und ohne Wenn und Aber erfolgen kann - geht es in der Regel nie darum, festzulegen, seit wann dieser andere anzuerkennende Staat denn schon als eigenes Völkerrechtssubjekt existiert, sondern es geht in der Regel immer nur darum, aus dem Standpunkt jetzt und heute zu sagen: «Jawohl, wir anerkennen euch». Nur aufgrund der speziellen Situation, in die liechtensteinische Bürger durch die meiner Meinung nach völlig rechtswidrigen Benes-Dekrete - so weit sie liechtensteinische Bürger betrafen - im Jahr 1945 geraten sind, legt Liechtenstein Wert auf diese Rückwirkung. Die wollen die Tschechen und Slowaken nicht zugestehen. Das ist richtig. Aber deswegen kann man nicht sagen: Sie wollen unsere Souveränität nur eingeschränkt oder - wie es in einer etwas nebulosen Wortbildung heisst - «nicht integral» anerkennen. Für den heutigen Zeitpunkt stimmt das nicht. Und leider muss ich sagen, das bedaure ich, leider wurden diese doch für uns ansonsten sehr positiven Erklärungen, die nämlich zustande gekommen wären als Bestandteil der Schlussakte, ohne dass wir irgendwelche Erklärungen zugunsten dieser beiden Staaten hätten abgeben müssen, die wurden dann aufgrund der von Liechtenstein neu am 9. Oktober 2003 verlangten zusätzlichen Erklärung betreffend den Umstand, dass Liechtenstein sowohl im Ersten als auch im Zweiten Weltkrieg ein neutraler, souveräner und anerkannter Staat war, wurden die verunmöglicht, indem die Tschechen und Slowaken ihre ursprünglich vorgesehenen Erklärungen dann durch etwas dürre und wenig aussagekräftige Erklärungen ersetzt haben, wie sie hier auf den Seiten 46 und 47 abgedruckt sind. Dies nur zur Klarstellung. Abg. Hugo Quaderer:
Vielen Dank. Ich werde diesen Anträgen der Regierung ebenfalls zustimmen. Ich habe aber noch konkrete Fragen an die Regierung und möchte zuerst an das Votum der Abg. Ingrid Hassler anknüpfen. Sie hat das Problem des Beizugs von Fachkräften nach Liechtenstein angesprochen. Es heisst auf Seite 55 des Berichts - ich zitiere: «Es ist auch hervorzuheben, dass während der Übergangsfrist Staatsangehörigen der neuen Mitgliedstaaten über die Erteilung einer Grenzgängerbewilligung bei entsprechender Ausbildung und Berufserfahrung der Zugang zum Arbeitsmarkt gewährt werden kann, wenn eine entsprechende Nachfrage seitens der liechtensteinischen Wirtschaft gegeben sein sollte». Das tönt zumindest sehr verlockend für die liechtensteinische Wirtschaft, hier Fachkräfte nach Liechtenstein holen zu können, weil, diese Arbeitskräfte aus den neuen Beitrittsländern sollen dann als Grenzgänger an die liechtensteinischen Arbeitsplätze gelangen. Dies bedingt aber natürlich, dass sie im benachbarten Ausland auch Wohnsitz nehmen können. Ich denke hier insbesondere an Österreich. Und meine Frage geht an die Regierung: Wissen Sie, wie Österreich die Wohnsitznahme von diesen Staatsbürgern aus den neuen EWR-Beitrittsländern handhabt? Wenn Österreich hier nämlich den Riegel schiebt, denke ich, ist diese Möglichkeit, als Grenzgänger nach Liechtenstein zu kommen, wieder dahin. Vielleicht kann die Regierung dazu schon Ausführungen machen.Ich habe dann noch eine Verständnisfrage zum neuen Protokoll 38a: Im Protokoll 38a geht es um den EWR-Finanzierungsmechanismus. Dort ist in Art. 10 Folgendes festgehalten - ich zitiere wieder: «Wird einer der in Art. 5 dieses Protokolls aufgeführten Empfängerstaaten nicht am 1. Mai 2004 Vertragspartei des Abkommens» - und dann kommt das, um was es mir geht - «oder ändert sich die Mitgliedschaft auf der EFTA-Seite des Europäischen Wirtschaftsraumes, so werden an diesem Protokoll die erforderlichen Anpassungen vorgenommen». Also, ich interpretiere das nun so, dass, wenn sich die Mitgliedschaft auf der EFTA-Seite ändern sollte, so werden dann die erforderlichen Anpassungen vorgenommen. Was heisst das nun konkret und welche Auswirkungen könnte dies für Liechtenstein haben? In diesem Zusammenhang möchte ich auch die Regierung fragen: Kann sie eine Einschätzung abgeben, wie sich Norwegen hinsichtlich eines baldigen EU-Beitrittes verhalten könnte? Und wenn wir dann bei diesem Szenario jetzt bleiben, um auf die konkrete Frage zurückzukommen und immer die Hypothese vorangestellt, Norwegen würde jetzt aus der EFTA austreten und der EU beitreten, wären dann in einem solchen Fall Island und Liechtenstein automatisch aufgrund dieses Wortlautes verpflichtet, die auf die EFTA-/EWR-Staaten fallenden EURO 120 Mio. gemäss Art. 2 dieses Protokolls selbst zu finanzieren? Ich will nur hier Klarheit haben, dass es hier nicht um einen automatischen Mechanismus geht, sondern ich gehe davon aus, dass das dann neu verhandelt werden würde. Ich bitte die Regierung dazu noch um eine Stellungnahme. Danke.Landtagspräsident Klaus Wanger:
Wenn es keine weiteren Wortmeldungen mehr gibt, gebe ich das Wort Herrn Regierungsrat Walch.Regierungsrat Ernst Walch:
Herr Präsident, meine Damen und Herren Abgeordnete. Erlauben Sie mir, dass ich zum Bericht und Antrag bzw. zum Inhalt des bei Ihnen zur Behandlung anstehenden EWR-Erweiterungsabkommens aufgrund der grossen Bedeutung des EWR an sich für unser Land und unsere Wirtschaft und aufgrund der inzwischen zehnjährigen Geschichte desselben einige grundsätzliche Ausführungen mache, die diejenigen im Bericht und Antrag ergänzen, vertiefen und vielleicht gleichzeitig auch Antworten auf einige der Fragen geben können.
Ich möchte folgende Themen ausführlicher ansprechen:- Die Ausgangslage und den Verhandlungsverlauf bis zum Abschluss bzw. zur Unterzeichnung des Abkommens;
- Die für Liechtenstein besonders wichtigen Themen, die sich aus dem Inhalt des Abkommens selbst ergeben, nämlich die Bereiche des Personenverkehrs und der künftigen finanziellen Beteiligung;
-
Die für Liechtenstein speziell gegebene Ausgangslage aus dem Verhältnis zwischen Liechtenstein und der Tschechischen bzw. Slowakischen Republik;
- Die Auswirkungen aus wirtschaftlicher Sicht, die auch darstellen sollen, in welchen Wirtschaftssektoren sich allenfalls Fragen der vermehrten Konkurrenz aus den neuen EWR-Mitgliedstaaten ergeben können und
- schliesslich eine Gesamteinschätzung, wie sie die Regierung zum Abkommen vorgenommen hat.
Zum Punkt 1, zur Ausgangslage und zum Verhandlungsverlauf: Mit der Entscheidung, die EU um zehn Mitglieder zu erweitern, ergab sich praktisch automatisch die Notwendigkeit, das bisherige EWR-Abkommen, zu dem auf Nicht-EU-Seite Island, Liechtenstein und Norwegen gehören, auf die neuen EU-Mitgliedstaaten auszuweiten. Natürlich stand aus der Sicht der EU selbst der Abschluss der Verhandlungen zum Beitritt der neuen Staaten zur EU im Vordergrund, bevor konkret über die Erweiterung des EWR um diese Staaten verhandelt werden konnte.
Erst nachdem sich beim Treffen des Europäischen Rats in Kopenhagen am 12. und 13. Dezember 2002 die EU-Mitgliedstaaten und die zehn Beitrittsländer auf einen entsprechenden Beitrittsvertrag und ein Finanzpaket für die ersten Jahre der Erweiterung geeinigt hatten, konnten weitere konkrete Schritte gesetzt und das Beitrittsdatum auf den 1. Mai 2004 festgelegt werden. Während es so aussieht, dass alle EU-Staaten ihre Verträge betreffend den Beitritt der zehn neuen Staaten zur EU auf den 1. Mai 2004 ratifiziert haben werden, ist dies beim EWR-Erweiterungsabkommen nicht der Fall. Es ist bereits jetzt klar, dass das EWR-Erweiterungsabkommen - darauf wird auch im Bericht und Antrag hingewiesen - ab dem 1. Mai 2004 auf der Basis einer von allen Vertragsparteien akzeptierten Erklärung vorläufig angewendet wird, bis das Ratifikationsverfahren in allen Staaten abgeschlossen ist.
Liechtenstein wird, sofern es kein Referendum zum EWR-Vertrag bzw. zum Beschluss des Landtags gibt, die Frist einhalten können und auf den 1. Mai 2004 ratifiziert haben. Ein kurzer Rückblick zum EWR-Abkommen vom 2. Mai 1992: Zur Bedeutung des EWR-Abkommens vom 2. Mai 1992, dem Liechtenstein am 1. Mai 1995 beigetreten ist, hat die Regierung bei verschiedenen Gelegenheiten zusammenfassend positive Auswirkungen für Liechtenstein festgestellt, wenn auch darauf hinzuweisen ist, dass die Umsetzung von einzelnen Teilen des EWR-Rechts nicht problemlos bzw. ohne sehr grossen Aufwand möglich ist. Diese grundsätzlich positive Haltung gilt für die Regierung auch weiterhin und diese Haltung ist auch Bestandteil der Argumente, die bei der Gesamtwürdigung des EWR-Erweiterungsabkommens zu berücksichtigen sind.Zur Erinnerung: Was ist das Ziel des EWR-Abkommens? Es heisst gemäss Art. 1 Abs. 1 des Abkommens: «eine beständige und ausgewogene Stärkung der Handels- und Wirtschaftsbeziehungen zwischen den Vertragsparteien unter gleichen Wettbewerbsbedingungen und die Einhaltung gleicher Re-geln zu fördern, um einen homogenen Europäischen Wirtschaftsraum zu schaffen». Zur Verwirklichung der genannten Ziele umfasst das EWR-A, also das Abkommen, den freien Warenverkehr, den freien Personenverkehr, den freien Dienstleistungsverkehr, den freien Kapitalverkehr, die Einrichtung eines Systems, das den Wettbewerb vor Verfälschungen schützt und die Befolgung der diesbezüglichen Regeln für alle in gleicher Weise gewährleistet sowie eine engere Zusammenarbeit in anderen Bereichen wie Forschung und Entwicklung, Umwelt, Bildungswesen und Sozialpolitik.Die Auswirkungen der EU-Erweiterung auf den EWR: Die Mitgliedschaft in der EU bedeutet grundsätzlich die vollständige Übernahme der bestehenden Rechtsvorschriften der EU, des so genannten Acquis communautaire zum Zeitpunkt des Beitritts. Die Homogenität des EWR, die eine Anpassung der nationalen Regeln der drei EFTA-/EWR-Staaten an die Regeln des EU-Binnenmarkts beinhaltet und diesen somit auf die Märkte der drei EFTA-/EWR-Staaten ausdehnt, verlangt ihrerseits wiederum, dass sämtliche neuen Mitglieder der EU und damit des EU-Binnenmarkts auch am EWR teilnehmen.
Beim EWR-Beitritt der neuen EU-Mitglieder handelt es sich also um die parallele Ausweitung des EWR entsprechend dem dann bereits 25 EU-Mitgliedstaaten umfassenden EU-Binnenmarkt. Der EWR wird dann – unter Einschluss der Europäischen Gemeinschaft – aus 29 Vertragspartnern bestehen.In Anbetracht der politischen Perspektive sowie des Grundprinzips der Homogenität im EWR haben die EU-Beitrittsverhandlungen und deren Resultate in den EWR-relevanten Gebieten die Bedingungen eines EWR-Beitritts für die zehn Kandidatenländer sehr stark präjudiziert. So wäre es schwer vorstellbar, dass in gleichen Regelungsmaterien wesentlich unterschiedliche Anpassungen oder Übergangsfristen im Verhältnis der EU-Kandidatenländer zu den EU-Mitgliedstaaten sowie im Verhältnis der EU-Kandidatenländer zu den drei EFTA-/EWR-Staaten sinnvoll nebeneinander bestünden. Trotzdem konnte spezifischen Situationen oder Gegebenheiten betreffend die Beziehungen zwischen den drei EFTA-/EWR-Staaten und den Kandidatenländern Rechnung getragen werden.
Nur ganz kurz ein Verweis zu unserem Verhältnis mit der Schweiz: Das Verhältnis zwischen Liechtenstein und der Schweiz bedarf im Hinblick auf das EWR-Erweiterungsabkommen keiner Anpassungen. Es bestand auch kein Anlass für Liechtenstein, mit den EWR-Partnern aufgrund des Verhältnisses Liechtensteins zur Schweiz vertragliche Anpassungen im Hinblick auf die EWR-Erweiterung vorzunehmen. In dieser Hinsicht ist also die Ausgangslage für Liechtenstein im Vergleich zu jener beim Beitritt zum EWR selbst eine völlig andere.Nun zu den Verhandlungen: Im Rahmen der von mir dargestellten Ausgangslage begannen die EWR-Beitrittsverhandlungen offiziell am 9. Januar 2003. Erst Anfang Juni 2003 konnten Lösungen zu wichtigen Fragen gefunden werden. Die Paraphierung der Texte fand am 3. Juli 2003 - übrigens unter liechtensteinischem Vorsitz - in Brüssel statt. Am 13. Oktober 2003 haben alle Vertragsparteien, mit Ausnahme Liechtensteins, Islands und Norwegens sowie der EU-Kommission und des Vorsitzlandes Italien, das als letztes Land unterzeichnete, das Erweiterungsabkommen unterzeichnet. Liechtenstein, Island und Norwegen unterzeichneten das Abkommen am 11. November 2003 in Vaduz, Italien und die EU-Kommission am gleichen Tag in Brüssel. Das Abkommen und die Schlussakte tragen aber trotzdem das Datum vom 14. Oktober. Das ist eine «Trivial Pursuit Question» für die Zukunft: Was geschah in Bezug auf das EWR-Erweiterungsabkommen vom 14. Oktober 2003? Am 14. Oktober 2003, also an jenem Datum, geschah gar nichts. Unterschrieben wurde am 13. Oktober bzw. am 11. November.Ich komme nun zum zweiten grossen Punkte meiner Ausführungen, die für Liechtenstein besonders wichtigen Themen, die sich aus dem Inhalt des Abkommens selbst ergeben, nämlich die Bereiche des Personenverkehrs und der künftigen finanziellen Beteiligung: Zunächst zur Freizügigkeit der Arbeitnehmer nach der EWR-Erweiterung: Der freie Personenverkehr ist eine der durch das EWR-Recht garantierten Grundfreiheiten. EWR-Staatsangehörige haben das Recht, in einem anderen Mitgliedstaat zu leben und zu arbeiten. Das Recht auf Freizügigkeit innerhalb des EWR geniessen nicht nur Arbeitnehmer, sondern auch andere Personengruppen wie etwa Studenten und Rentner. Ergänzend zum Bericht und Antrag Nr. 2/1004 wird erläutert, welche Freizügigkeitsregelungen nach der EWR-Erweiterung für Staatsangehörige aus den neuen Mitgliedstaaten gelten werden. Es sei darauf hingewiesen, dass die Übergangsregelung ausschliesslich für den Zugang von Arbeitnehmern zum Arbeitsmarkt gilt.
Nun, was beinhalten diese Übergangsregelungen?
Die EU-Erweiterungsverträge sehen eine bis zu siebenjährige Übergangsregelung hinsichtlich des Zugangs zum Arbeitsmarkt durch Staatsangehörige der neuen EU- bzw. EWR-Staaten vor. Diese siebenjährige Übergangsregelung ist in eine zwei-, drei- und in eine zweijährige Übergangsfrist aufgeteilt. Die erste Übergangsfrist von zwei Jahren kann von jedem EU- bzw. EWR-Staat hinsichtlich der Staatsangehörigen der neuen EWR-Mitgliedstaaten, davon ausgenommen Malta und Zypern, angerufen werden. Während dieser zweijährigen Übergangszeit kann jeder EU- bzw. EWR-Staat seine nationalen Bestimmungen gegenüber den neuen EWR-Staatsangehörigen weiterhin anwenden. Eine spezielle Anwendung der Anrufung dieser Übergangsfrist ist nicht notwendig.
Allgemein wird in den ersten beiden Jahren nach dem Beitritt der neuen EWR-Mitgliedstaaten der Zugang zu den nationalen Arbeitsmärkten der derzeitigen EWR-Mitgliedstaaten durch die einschlägigen nationalen Rechtsvorschriften und die jeweilige Politik der einzelnen Staaten geregelt sowie durch etwaige mit den neuen EWR-Mitgliedstaaten geschlossene bilaterale Abkommen. Solche hat Liechtenstein nicht geschlossen. Zwei Jahre nach dem Beitritt, das heisst, im Mai 2006, wird die Kommission einen Bericht ausarbeiten, auf dessen Grundlage der Rat eine Überprüfung der bestehenden Übergangsregelung vornimmt. Ausserdem müssen alle derzeitigen EU-Mitgliedstaaten der Kommission formell mitteilen, ob sie beabsichtigen, für einen Zeitraum von maximal drei weiteren Jahren nationale Massnahmen beizubehalten oder aber die gemeinschaftsrechtlichen Vorschriften anzuwenden. An wen die Mitteilung der EWR/EFTA-Staaten nach Ablauf der zwei Jahre zu erfolgen hat, ist derzeit noch nicht ganz geklärt. Gemäss Protokoll 1 zum EWR-Abkommen muss dies die EFTA-Überwachungsbehörde sein.
Grundsätzlich soll die Übergangsregelung fünf Jahre nach dem Beitritt, das heisst, im Jahr 2009, auslaufen. Allerdings besteht für die derzeitigen EU-Mitgliedstaaten die Möglichkeit, die Kommission um Genehmigung zu ersuchen, auch weiterhin – für einen zusätzlichen Zeitraum von zwei Jahren – nationale Massnahmen anzuwenden, sofern der nationale Arbeitsmarkt sich mit schwer wiegenden Problemen konfrontiert sieht oder die Gefahr derartiger Probleme gegeben ist. Den EWR-Mitgliedstaaten steht dieses Recht auch zu. Die Geltungsdauer der Übergangsregelung darf in keinem Fall sieben Jahre überschreiten. Das heisst, spätestens im Jahr 2011 sollte die Arbeitnehmerfreizügigkeit für die Staatsangehörigen aus den neuen EWR-Mitgliedstaaten Realität werden.
Welche Staaten haben bis anhin von der Übergangsregelung Gebrauch gemacht?
Nach aktuellem Stand der Dinge werden alle derzeitigen EWR-Mitgliedstaaten, auch die drei EFTA-/EWR-Staaten, von den Beschränkungsmöglichkeiten gemäss Übergangsregelung Gebrauch machen. Irland war der letzte Staat, der diese Mitteilung gemacht hat.
Liechtenstein wird mindestens von der zweijährigen Übergangsfrist Gebrauch machen. Dazu ist eine Abänderung der Personenverkehrsverordnung (PVO) notwendig. Diese PVO-Änderung wird bis zum 1. Mai 2004 in Kraft gesetzt werden. In der PVO-Änderung ist ein neuer Artikel eingefügt worden, durch welchen festgehalten wird, dass Staatsangehörige der neuen EWR-Mitgliedstaaten für mindestens zwei Jahre hinsichtlich des Zugangs zum Arbeitsmarkt und zur Wohnsitznahme zum Erwerb in Liechtenstein als Erwerbstätige wie Drittstaatangehörige behandelt werden. Das ist eine Antwort auf die Frage eines Abgeordneten. Noch einmal: Staatsangehörige der neuen EWR-Mitgliedstaaten werden für mindestens zwei Jahre hinsichtlich des Zugangs zum Arbeitsmarkt und zur Wohnsitznahme zur Erwerbstätigkeit in Liechtenstein als Erwerbstätige wie Drittstaatangehörige behandelt werden. Ich habe schon ausgeführt, dass diese Übergangsregelung Anwendung findet auf alle neuen Mitgliedsländer ausser Zypern und Malta, das heisst also auf Tschechien, Estland, Lettland, Litauen, Ungarn, Polen, Slowenien
und die Slowakei. Gelten diese Beschränkungen für Personen, die nicht Arbeitnehmer gemäss Art. 28 des EWR-Abkommens sind, auch?
Die Übergangsregelung gilt ausschliesslich für Arbeitnehmer, nicht aber für Selbstständige, Dienstleitungserbringer und -empfänger, Studenten, Rentner, Touristen und andere nicht erwerbstätige Personen.
Die Wohnsitznahme von Staatsangehörigen aus den neuen EWR-Staaten als Erwerbslose in Liechtenstein - diesbezüglich gilt folgende Regelung: Da die Übergangsfristen nur den Zugang zum Arbeitsmarkt regeln, kann die erwerbslose Wohnsitznahme in Liechtenstein aufgrund der Übergangsfrist nicht beschränkt werden. Staatsangehörige der neuen EWR-Staaten, welche über ausreichende finanzielle Mittel verfügen, einen entsprechenden Versicherungsschutz nachweisen können und über eine angemessene Wohnung verfügen, können sich daher in Liechtenstein niederlassen, wobei - und das ist natürlich das Entscheidende - für sie gilt die Nicht-Erwerbstätigen-Quote von 16 Personen pro Jahr gemäss der speziellen Personenverkehrslösung für Liechtenstein.Ich komme zu einem zweiten Punkt, nämlich - und kein uninteressanter, der aber heute nicht angesprochen wurde - zur Beteiligung an EU-Programmen im Rahmen des EWR: Die Grundlage für die Beteiligung der EFTA-/EWR-Staaten an EU-Programmen befindet sich in Art. 78 ff. des EWR-Abkommens. Art. 78 enthält einen nicht abschliessenden Katalog von Bereichen (Forschung und technologische Entwicklung, Informationsdienste, Umwelt, Bildung, Jugend, Sozialpolitik, Verbraucherschutz, KMU, Fremdenverkehr, audiovisueller Sektor und Katastrophenschutz), in welchen die Vertragsparteien ihre Zusammenarbeit verstärken und erweitern können. Der Nutzen einer Beteiligung an EU-Programmen liegt darin, dass im Rahmen der Programme Projekte zur finanziellen Förderung bei der EU eingereicht werden können.
Die gesamten Kosten im Bereich der Programmbeteiligung belaufen sich für Liechtenstein auf jährlich zirka CHF 900'000 bis CHF 1 Mio. Der weitaus grösste Teil dieses Betrags, nämlich drei Viertel, also etwa 75%, entfällt auf die Beteiligungskosten für das Forschungsprogramm der EU. Hinsichtlich des Sechsten Rahmenprogramms gibt es noch keine aussagekräftigen Erfahrungen in Bezug auf den Nutzen für Liechtenstein, da dieses erst am 1. Januar 2003 gestartet ist. Die Erfahrungen mit dem Vorgängerprogramm, also von 1999 bis 2002, zeigen jedoch, dass die Fördergelder, die an die liechtensteinische Industrie bzw. Wirtschaft zurückfliessen, die Beteiligungskosten übersteigen. Das Amt für Volkswirtschaft erhielt Kenntnis (Stand Juli 2002) von insgesamt 49 eingereichten Projekten. Darunter befinden sich auch Wiedereinreichungen von Projekten, welche abgelehnt und abgeändert, erneut eingereicht wurden. Von diesen 49 Projekten wurden 15 positiv bewertet und es wurden mit der Europäischen Kommission Verträge abgeschlossen bzw. die Vertragsverhandlungen liefen zum Referenzzeitpunkt noch. Wie viele Gelder als Förderung wieder zurückfliessen, ist schwierig vorherzusagen, da im Vertrag Sätze vereinbart werden können, die von jenen im eingereichten Projekt abweichen. Werden aber die beantragten Fördergelder der angenommenen Projekte zusammengezählt, erhält man einen Betrag von zirka EURO 3,5 Mio. Dieser Betrag übersteigt offensichtlich die Gesamtbeteiligungskosten Liechtensteins am Fünften Rahmenprogramm um EURO 2,5 Mio.An zweiter Stelle - an erster Stelle waren die 75% Forschungsprogramm - an zweiter Stelle folgen die Programme im Bereich «Bildung und Jugend», die zirka 20% der gesamten Programmkosten ausmachen. Auch hier decken bzw. übersteigen die zugeteilten Fördermittel die Beteiligungskosten. Für die grössten Programme in diesem Bereich ergibt sich folgendes Bild:
Zweite Phase des gemeinschaftlichen Aktionsprogramms im Bereich der allgemeinen Bildung - besser bekannt unter «Sokrates». Die Beteiligungskosten für Liechtenstein insgesamt für die gesamte Laufzeit betragen EURO 231'000. Der Nutzen für Liechtenstein: Für Schulen allgemein, für Schülerinnen und Schüler, für Lehrpersonen sowie für Bildungsverantwortliche. Mit Ausnahme des Erasmus-Programms decken die zugeteilten Mittel die Auszahlungen insgesamt. Bis anhin wurden folgende Fördermittel an Liechtenstein zugeteilt: EURO 50'000, EURO 98'000 und EURO 70'000. Die zweite Phase des gemeinschaftlichen Aktionsprogramms in der Berufsbildung ist bekannt unter dem Namen «Leonardo-da-Vinci»-Projekt. Dort betragen die Beteiligungskosten für Liechtenstein für die Gesamtlaufzeit zirka EURO 125'000. Seit dem Jahr 2000 hat die Nationalagentur «Leonardo da Vinci» EURO 1,229 Mio. an Fördergeldern erhalten. Dann gibt es noch das gemeinschaftliche Aktionsprogramm «Jugend». Die
Beteiligungskosten für Liechtenstein betragen zirka EURO 75'000. Liechtenstein beteiligt sich seit 1997 aktiv an diesem Programm. Mit den Gemeinschaftsmitteln wer-den die Nationalagentur und Projekte gefördert. Das Jugendinformationszentrum «aha-Tipps» und «Infos für junge Leute» nimmt die Funktion und Aufgaben der nationalen Agentur wahr. Der Kinder- und Jugenddienst vertritt die nationalen Interessen bei der Europäischen Kommission. Die Beteiligung der Jugendlichen aus Liechtenstein am Programm hat enorm zugenommen. Allein im Bereich Jugendaustausch beteiligten sich Jugendliche an sechs verschiedenen Projekten. Liechtenstein erhält derzeit um ein Weites mehr an Fördergeldern als einbezahlt wurde. Nach diesen Zahlen komme ich noch zum EWR-Finanzierungsinstrument: Das aktuelle Finanzinstrument hat gemäss Beschluss 47/2000 des Gemeinsamen Ausschusses eine Laufzeit vom 1. Januar 1999 bis 31. Dezember 2003. In dieser Periode wurden insgesamt 25 Projekte gutgeheissen. Diese Projekte absorbieren total einen Betrag von EURO 113 Mio., was zirka 95% der von den EFTA-/EWR-Staaten im Rahmen des Finanzinstruments bereitgestellten Mitteln entspricht.
Bisher wurden im Rahmen des Finanzinstruments allerdings noch keine Auszahlungen für die genannten Projekte gemacht. Eine Auszahlung erfolgt erst nach erfolgreichem Abschluss des Projekts. Die Einhaltung der verschiedenen Konditionen und Kriterien, die das Projekt zu erfüllen hat, wird in einem Abschlussbericht überprüft. Erst nach Verabschiedung des Abschlussberichts durch den Finanzinstrument-Ausschuss darf der volle Betrag ausbezahlt werden. Kleinere Anzahlungen können bereits in einem früheren Stadium gemacht werden.
Vielleicht einfach aus Interesse: Griechenland hat von diesen genannten Mitteln zirka EURO 22 Mio. zugesprochen erhalten, Irland zirka EURO 5,5 Mio., Portugal zirka EURO 21,2 Mio. und den Löwenanteil von mehr als 50% erhält Spanien mit EURO 64,1 Mio. Nordirland bekommt noch EURO 0,5 Mio., was 0,5% entspricht. Nun zu den Beitragszahlungen zum Finanzmechanismus 2004 bis 2009, der ja Nachfolge des Vorgänger-Finanzinstruments ist: Durch den Einbezug überproportional armer Regionen auf dem Gebiet der neuen EU-Mitgliedstaaten werden die Beitragzahlungen Liechtensteins anstatt auf das Zwanzigfache, wie in den EWR-Erweiterungsverhandlungen seitens der EU verlangt worden war, «nur» auf das Fünffache steigen. Das sind rund EURO 1,5 Mio. pro Jahr bis zum Jahre 2009. Insgesamt wird der EWR/EFTA-Beitrag EURO 600 Mio. betragen, das heisst, EURO 120 Mio. pro Jahr. Für Liechtenstein ergibt sich eine Gesamtverpflichtung von rund EURO 4,5 Mio. Das entspricht heute etwa dem Betrag von CHF 7, 3 Mio. oder auf das Jahr verteilt zirka EURO 900’000 oder CHF 1, 44 Mio. pro Jahr. Der EWR-Finanzmechanismus dient einer verstärkten Zusammenarbeit im Hinblick auf den Abbau der wirtschaftlichen und sozialen Unterschiede im EWR, der letztlich auch dazu beitragen soll, den ganzen EWR-Binnenmarkt zu einem der wettbewerbsfähigsten Märkte der Welt zu machen. Dieser Betrag erscheint der Regierung im Hinblick auf die zu erwartenden wirtschaftlichen und politischen Vorteile als durchaus angemessen.
Übrigens werden die konkreten Modalitäten des Finanzinstruments derzeit noch verhandelt. Ich komme zum dritten Punkt, nämlich zu den Beziehungen Liechtensteins zur Tschechischen Republik und zur Slowakischen Republik: Auf dieses Thema wird im Bericht und Antrag bewusst ausführlich eingegangen, da sich die Regierung im Vor- und im Umfeld der Unterzeichnung des EWR-Erweiterungsabkommens massiven und durchgehend ungerechtfertigten Vorwürfen ausgesetzt sah. Ich möchte mich beim Herrn Landtagsvizepräsidenten bedanken, dass er die Stellungnahme und die Darlegung im Bericht und Antrag als rational und emotionslos gesehen hat, denn darum ging es uns immer innerhalb der Regierung. Nur die Politik machte dieses oder jenes daraus. Das ist uns selbstverständlich bewusst.Es sollte zum Teil der Regierung unterstellt werden, sie verzögere bewusst die Unterzeichnung und das anschliessende Ratifikationsverfahren der einzelnen Vertragsparteien und stelle damit grundsätzlich die Interessen Liechtensteins am EWR selbst und an der EWR-Erweiterung in Frage. Ich erlaube mir daher, Ihnen die Ausgangslage in der gebotenen Kürze nochmals darzustellen:
Die Situation vor der Paraphierung des Erweiterungsabkommens am 3. Juli 2003: In einem Aide-mémoire vom 4. April 2003 zuhanden aller künftigen Vertragsparteien begrüsste die Regierung die anstehende EWR-Erweiterung und die fortschreitende Integration in Europa. Sie machte aber gleichzeitig auch auf die offenen Fragen in den Beziehungen zwischen Liechtenstein, der Tschechischen Republik und der Slowakischen Republik aufmerksam. Die Regierung stellte nicht die aus Sicht der betroffenen Staaten behauptete Rechtmässigkeit der Benes-Dekrete in Frage, sondern behandelte die offenen Fragen unter dem für Liechtenstein wesentlichen Aspekt der Anerkennung der liechtensteinischen Souveränität. Die Regierung stellte dar, dass das EWR-Abkommen ein Vertrag unter internationalem Recht ist und daher die Vertragsparteien sich gegenseitig als souveräne Staaten anerkennen müssen. Im Weiteren wurde auf die bisher geführten Verhandlungen zu den offenen Fragen eingegangen, und es wurden Vorschläge zum weiteren Vorgehen gemacht. Die Regierung erklärte dabei, dass sie sich bewusst sei, dass die Frage der Behandlung von Eigentum nicht in kurzer Frist bereinigt werden kann. Die Regierung verlangte aber von den beiden Staaten, wie dies ihr Vorgängerstaat, die Tschechoslowakei, im Jahr 1938 tat, dass die beiden Staaten Liechtenstein vorbehaltlos als souveränen Staat anerkennen und ihre Bereitschaft erklären, zu den offenen Fragen bezüglich des Eigentums im Rahmen einer friedlichen Streitbeilegung eine Lösung zu erreichen. Vor diesem Hintergrund hatte Liechtenstein diesbezüglich den beiden Staaten eine Note zukommen lassen und die Vertragsparteien des Erweiterungsabkommens um Unterstützung der Anliegen Liechtensteins ersucht.
Liechtenstein hatte dann im Hinblick auf die Paraphierung des Erweiterungsabkommens am 3. Juli 2003 - wovon ich schon gesprochen habe - eine Erklärung abgegeben. Darin ging die Regierung von der Annahme aus, dass die Tschechische Republik und die Slowakische Republik Liechtenstein ohne Vorbehalt anerkennen. Im Gegenzug anerkennt Liechtenstein diese beiden Staaten. Weiters nahm sie an, dass eine einvernehmliche Lösung der noch offenen Frage hinsichtlich der entschädigungslosen Enteignungen im Jahre 1945 in beiderseitigem Interesse ist. Die Regierung schlug hierfür vor, Mechanismen für die friedliche Beilegung von Streitigkeiten in Anspruch zu nehmen, zum Beispiel den Valletta-Mechanismus der OSZE.
Was war die Entwicklung nach der Paraphierung des Erweiterungsabkommens am 3. Juli 2003 bis zur Unterzeichnung vom 13./14. Oktober bzw. 11. November 2003? Die Standpunkte Liechtensteins einerseits und Tschechiens und der Slowakei andererseits waren damit nicht miteinander vereinbar. In Verhandlungen wurde daher versucht, im Hinblick auf die Unterzeichnung des EWR-Erweiterungsabkommens zu einer einvernehmlichen Lösung bzw. Festlegung der weiteren Schritten zu gelangen. Nachdem diese Verhandlungen von tschechischer Seite für Liechtenstein unerwartet - nachdem die Verhandlungen sehr weit gediehen waren, ja sogar so weit, dass intern die Regelung unter Botschaftern schon bestanden hatte, nämlich eine Anerkennung ab 1806 - nachdem also diese Verhandlungen von tschechischer Seite für Liechtenstein unerwartet abgebrochen worden waren, stellte die Regierung allen Vertragsparteien des Erweiterungsabkommens das Aide-mémoire vom 23. September 2003 zu.
Schliesslich sah sich die Regierung veranlasst, in einer Note vom 9. Oktober 2003 allen Vertragsparteien des Erweiterungsabkommens mitzuteilen, die Regierung gehe davon aus, dass alle Vertragsparteien das Fürstentum Liechtenstein als lange bestehenden souveränen Staat, der im ganzen Ersten und Zweiten Weltkrieg neutral war, anerkennen. Wenn diese Erklärung für alle Vertragsparteien unbestritten und annehmbar sei, sei Liechtenstein in der Lage, das EWR-Erweiterungsabkommen zu unterzeichnen.
Während alle anderen Vertragsparteien keine Einwände erhoben, brachten die Tschechische Republik sowie die Slowakische Republik kurz vor der Unterzeichnung des Erweiterungsabkommens, nämlich am Freitagabend des 10. Oktober 2003, durch ihre Erklärungen Vorbehalte an.
Die Entwicklung nach dem 13. bzw. 14. Oktober 2003 haben wir alle mitverfolgen können. Die Regierung sah sich daher veranlasst, die Unterzeichnung des Abkommens am 13. bzw. 14. Oktober 2003 nicht vorzunehmen. Darüber informierte die Regierung alle künftigen Vertragsparteien am 13. Oktober 2003. Island und Norwegen schlossen sich am 14. Oktober dieser Haltung solidarisch und öffentlich an, und beide Staaten bemühten sich anschliessend, in Absprache mit Liechtenstein über Verhandlungen einen Kompromiss zu erreichen.
Schliesslich beschloss die Regierung - in Absprache mit Island und Norwegen - im Interesse des Weiterbestands des EWR und seiner Erweiterung – beides wurde von der Regierung nie in Frage gestellt – das Abkommen am 11. November 2003 in Vaduz zusammen mit Island und Norwegen zu unterzeichnen. Wie gesagt: Italien als Vorsitzland der EU unterzeichnete zusammen mit der Kommission am gleichen Tag, also am 11. November 2003, in Brüssel.
Anlässlich der Unterzeichnung des Abkommens am 11. November 2003 gab ich als Aussenminister eine Erklärung ab, in der ich erneut auf die ungelösten Fragen, aber auch auf die fehlende Respektierung der Souveränität Liechtensteins durch die beiden Staaten hinwies. Gleichzeitig habe ich auch das Recht der Regierung betont, dass Liechtenstein die möglichen politischen, rechtlichen und wirtschaftlichen Schlussfolgerungen aus dem Verhalten der beiden Staaten prüfen werde. Bei der Unterzeichnung gab ich aber auch der Hoffnung Ausdruck, dass in Zukunft eine Lösung zu dieser offenen Frage und zu anderen bilateralen Problemen zwischen dem Fürstentum Liechtenstein, der Tschechischen Republik und der Slowakischen Republik gefunden und so eine fruchtbare und gewinnbringende Zusammenarbeit unter allen Mitgliedern des EWR ermöglicht werde.
Zusammenfassend möchte ich feststellen, dass die Regierung dem ihr dauernd übertragenen Auftrag nachgekommen ist, die Interessen des Staates Liechtenstein wahrzunehmen und zu vertreten, die in diesem Zusammenhang vornehmlich und wesentlich auf die Frage der durchgehenden Anerkennung der Souveränität Liechtensteins ausgerichtet waren. Die zahlreichen Reaktionen aus dem Kreis der Vertragsparteien, die das Vorgehen Liechtensteins als richtig einschätzten, haben die Position der Regierung bestätigt. Die offenen Fragen Liechtensteins im Verhältnis zu den beiden Staaten sind damit einerseits in den einzelnen Aussenministerien ins Bewusstsein gerückt worden, andererseits konnten wir auch auf die Solidarität vor allem unserer beiden EFTA-Partner im EWR, nämlich Norwegen und Island zählen, die uns in all unseren Bemühungen tatkräftig und mit persönlichem Einsatz der Aussenminister unterstützt haben. Und da liegt auch einer der grossen Vorteile dieses Vorgehens, das die Regierung gewählt hatte, denn damit ist erstmals nach aussen Solidarität gezeigt worden. Für Liechtenstein ist die offene Frage gegenüber
Tschechien und der Slowakei keine lediglich bilaterale mehr, keine, die nur noch Liechtenstein gegenüber den beiden Staaten stellt, sondern die EWR-/EFTA-Staaten haben sich solidarisch erklärt. Die Kommission hat im Sinne Liechtensteins versucht, mit den beiden Mitgliedern zu verhandeln. Und das hat natürlich Zukunftswirkung. Das hat natürlich nicht nur Rückwirkung, sondern insbesondere Zukunftswirkung. Und damit ist auch die Position gegenüber Tschechien und der Slowakei insofern gestärkt, als die beiden Staaten erkennen, dass dieses Thema nicht nur ein bilaterales Thema ist, dass ein Verständnis vorhanden ist und von bestimmten Staaten konkret auch eine Unterstützung gegeben ist. Abgesehen von dieser direkten Frage hat das auch die Haltung Liechtensteins, die klare, zwar für den EWR kompromissbereite Haltung, aber in Bezug auf die Souveränität Liechtensteins im liechtensteinischen Verständnis, hat die kompromisslose Haltung natürlich auch ihre Auswirkungen auf andere Vertragsverhältnisse und Verhandlungen, denn Liechtenstein wurde und wird sicherlich als konsequent handelnder Verhandlungspartner angesehen.Nun komme ich zu den Auswirkungen aus wirtschaftlicher Sicht: Durch die EWR-Erweiterung erweitert sich der europäische Binnenmarkt ab dem 1. Mai 2004 um das Staatsgebiet der zehn neuen EU-Staaten. Aus wirtschaftlicher Sicht bieten sich für die Exportindustrie, den Finanzdienstleistungssektor und die Dienstleistungsunternehmungen neue, einiges versprechende Absatzmärkte, da dieser Binnenmarkt zukünftig fast 500 Millionen Bürger umfassen wird. Liechtensteinische Staatsangehörige und liechtensteinische Unternehmungen können aufgrund der im EWR ebenfalls geltenden Grundfreiheiten von diesem Markt im gleichem Masse wie EU-Staatsangehörige und EU-Unternehmungen profitieren. Eine eingehende volkswirtschaftliche Untersuchung über die Auswirkungen der EWR-Erweiterung wurde nicht durchgeführt. Die Auswirkungen sind, wie dies übrigens schon bei der Behandlung des EWR-Beitritts als solches der Fall war, schwer abzuschätzen und beruhen auf den Erfahrungen aus der Mitgliedschaft im EWR.
Zum Warenverkehr: Die bestehenden Regelungen zum Warenverkehr werden durch die EWR-Erweiterung in ihrem Bestand nicht geändert, sondern nur der örtliche Anwendungsbereich auf weitere zehn Staaten ausgedehnt.
Hervorzuheben ist die Übergangsregelung, nach welcher als Nachweis des Präferenz-Ursprungs im EWR auch jene Ursprungsnachweise gelten, die von einem EFTA-/EWR-Staat oder einer neuen Vertragspartei aufgrund eines Präferenzabkommens ordnungsgemäss spätestens am Tag vor dem In-Kraft-Treten ausgestellt worden ist und den Zollbehörden innerhalb vier Monaten nach In-Kraft-Treten vorgelegt wird. Für die liechtensteinischen Exporteure bedeutet die Ausweitung des Abkommens auf die zehn neuen Mitgliedstaaten einen grossen Vorteil, weil dadurch der EWR-Ursprung leichter zu erreichen bzw. beizubehalten ist. Da mit dem EWR-Ursprung im Industriebereich das zollfreie Exportieren bzw. Importieren einhergeht, ist die Ausdehnung des örtlichen Geltungsbereichs der Ursprungsregeln von grosser Bedeutung.
Ein Wort zur aktuellen Diskussion der Schweiz in Bezug auf Re-Importe von EU-Ursprungsprodukten in den EU-Raum: Zu diesen Diskussionen der Schweiz mit der EU hinsichtlich der zollpflichtigen Re-Importe von EU-Ursprungsprodukten aus einem Drittland (hier die Schweiz) in die EU kann ich feststellen, dass liechtensteinische Unternehmen davon nicht betroffen sind, wenn ihre Produkte EWR-Ursprung haben. Zur Arbeitnehmerfreizügigkeit: Diese Frage wurde mehrfach aufgeworfen. Alle liechtensteinischen Staatsangehörigen können im ganzen EWR-Raum – gleich wie EU-Staatsangehörige – Arbeit suchen, Arbeit aufnehmen und in diesem EWR-Staat Aufenthalt nehmen. Die jetzigen EWR-Staatsangehörigen können seit dem 1. Januar 1998 in Liechtenstein als Grenzgänger oder selbstständig Erwerbende unbeschränkt arbeiten bzw. sich geschäftlich niederlassen. Die Wohnsitznahme ist durch die Quotenregelung - ich erinnere an 56 für Erwerbstätige und 16 für Erwerbslose - pro Jahr beschränkt.
Von der Arbeitnehmerfreizügigkeit ausgenommen sind nach Art. 28 Abs. 4 EWRA die Beschäftigungen im öffentlichen Dienst. Gemäss der EuGH-Rechtsprechung zu diesem im EWRA vorhandenen spiegelbildlichen Artikel des EG-Vertrags ist das Abstellen auf die liechtensteinische Staatsbürgerschaft bei Tätigkeiten im öffentlichen Dienst, die mit hoheitlichen Tätigkeiten verbunden sind, zulässig. Zu solchen Tätigkeiten zählt man unter anderem die Diplomatie, die Rechtspflege, die Polizei und die Steuerverwaltung. Lehrer führen trotz der Kompetenz zur Notengebung - das war das Argument, um sie unter das hoheitliche Regime zu subsumieren - keine hoheitlichen Tätigkeiten aus. Das Abstellen auf das Landesbürgerrecht ist daher nicht zulässig. Das galt im jetzigen EWR und natürlich auch im erweiterten EWR. Das Gleiche gilt übrigens für Hausmeister, für Putzpersonal, für untergeordnete Dienste etc.
Die diesbezüglichen Änderungen durch die EWR-Erweiterung: EWR-Angehörige aus den neuen EWR-Staaten können – aufgrund der Anrufung der zweijährigen (der insgesamt bis sieben Jahre gestaffelten) Übergangsfrist in Liechtenstein nicht als Arbeitnehmer tätig werden. Angehörige aus Malta und Zypern sind davon - wie ich schon gesagt habe - ausgenommen.
EWR-Angehörigen aus den neuen EWR-Staaten muss – nach Ablauf dieser Übergangsfrist – der Zugang zu den nicht-hoheitlichen Stellen der öffentlichen Verwaltung im gleichen Ausmass wie heute den jetzigen EWR-Bürgern gewährt werden.
Eine Wohnsitznahme in Liechtenstein ist während der zweijährigen Übergangsfrist als Erwerbstätige nicht möglich. Neue EWR-Bürger, die über ausreichende Geldmittel verfügen, können sich um einen der 16 Quotenplätze für Erwerbslose - so genannte Privatiers - bemühen.
Durch die Anrufung der Übergangsfrist werden die neuen EWR-Bürger wie Drittstaatsangehörige behandelt. Aufgrund der restriktiven Regelungen kann ein Ansturm auf den liechtensteinischen Arbeitsmarkt verhindert werden. Dem Bedarf an Spezialkräften kann bei entsprechender Nachfrage aufgrund des Drittstaatenregimes im Ausnahmefall entsprochen werden.
Zur Niederlassungsfreiheit: Jeder Liechtensteiner und jedes in Liechtenstein rechtmässig errichtete Unternehmen kann im ganzen EWR-Raum Niederlassungen, Zweigstellen und Repräsentanzen gründen. Die jetzigen EWR-Staatsangehörigen bzw. EWR-Gesellschaften können dieses Recht in Liechtenstein nach Ablauf der Übergangsfrist per Ende 1997 ohne Wohnsitz in Liechtenstein ausüben. Dies hat – trotz des Nicht-Beitritts der Schweiz zum EWR – zu keiner Gründungswelle in Liechtenstein geführt. Im Gewerbebereich wurden vor und nach dem EWR-Beitritt pro Jahr im Durchschnitt 350 bis 400 Gewerbebewilligungen erteilt, also sowohl vor dem EWR-Beitritt als auch danach. Die Zahlen blieben im selben Rahmen. Dies war und ist vor allem für den Immobilien- und Arbeitsmarkt vorteilhaft. Allerdings wird dadurch auch die Abhängigkeit Liechtensteins von ausländischen Arbeitnehmern weiter ansteigen, was volkswirtschaftlich nicht ganz unproblematisch ist.
In Bezug auf die freien Berufe hinsichtlich der einzelnen Berufssparten möchte ich Nachfolgendes ausführen:
Neue EWR-Bürger bzw. Gesellschaften können ab 1. Mai 2005 in Liechtenstein unter den gleichen Bedingungen wie Liechtensteiner in Liechtenstein eine geschäftliche Niederlassung gründen. Das in Liechtenstein bzw. EWR-weit einheitlich geforderte hohe Ausbildungsniveau müssen alle Antragsteller erfüllen. Neue EWR-Bürger, die sich als Rechtsanwalt, als Arzt, Wirtschaftsprüfer, Architekt usw. in Liechtenstein als Selbstständige niederlassen wollen, müssen die einzelnen spezialgesetzlichen Regelungen erfüllen.
Aufgrund der angerufenen Übergangsfrist für Arbeitnehmer aus den neuen EWR-Mitgliedstaaten können diese Unternehmungen keine neuen EWR-Bürger als Arbeitnehmer einstellen. Die damit einhergehenden (höchstwahrscheinlich) höheren Lohnkosten werden viele neue EWR-Bürger von der Gründung einer geschäftlichen Niederlassung im Inland abhalten.
Nun kann ich, wenn das vom Landtag gewünscht ist - die Abg. Ingrid Hassler hat ersucht, entsprechende Ausführungen zu machen - kann ich betreffend Ärzte, Zahnärzte, nicht akademische Ausbildungen im Medizinalbereich, Rechtsanwälte, Architekten, Transportgewerbe bzw. überhaupt für das Gewerbe, Banken und andere im Finanzdienstleistungsbereich Tätige, Versicherungen, kann ich entsprechende Ausführungen machen. Ich habe sie bis anhin nur rudimentär und allgemein gehalten, aber nicht brachenspezifisch. Ich werde das dann tun, wenn das nach meinen grundsätzlichen Ausführungen weiter verlangt wird.Ein paar Bemerkungen zur Dienstleistungsfreiheit: Wie wir wissen, kann jeder Liechtensteiner und jedes in Liechtenstein rechtmässig errichtete und tätige Unternehmen im ganzen EWR-Raum – unter den gleichen Voraussetzungen wie EU-Bürger bzw. EU-Gesellschaften – grenzüberschreitend und zeitlich befristet Dienstleistungen anbieten. Die jetzigen EWR-Bürger bzw. EWR-Gesellschaften können dieses Recht in Liechtenstein seit dem EWR-Beitritt ausüben. Vor der erstmaligen Erbringung einer grenzüberschreitenden Dienstleistung muss eine Meldung an die jeweils zuständige Behörde erfolgen. In allen Bereichen der freien Berufe werden daher von Liechtenstein in den EWR-Raum als auch umgekehrt grenzüberschreitend Dienstleistungen angeboten. Nach EWR-Beitritt haben insbesondere grenznahe Gewerbebetriebe aufgrund des niedrigeren Preisniveaus in Österreich und Deutschland viele Aufträge in Liechtenstein erhalten. Da sich aber das Preisniveau der grenzüberschreitend tätigen EWR-Betriebe in den letzten Jahren dem liechtensteinischen angeglichen hat, ist die Konkurrenz von grenzüberschreitend tätigen Betrieben nicht mehr so gross wie direkt beim EWR-Beitritt.
Was für Änderungen ergeben sich durch die EWR-Erweiterung? Neue EWR-Bürger bzw. Gesellschaften können ab 1. Mai 2005 in Liechtenstein unter den gleichen Bedingungen wie die anderen EWR-Bürger in Liechtenstein grenzüberschreitend tätig sein. Da auch die neuen EWR-Bürger vor der erstmaligen Erbringung einer grenzüberschreitenden Dienstleistung eine Meldung an die jeweils zuständige Behörde zu erstatten haben, kann sichergestellt werden, dass nur Unternehmer, die das vorgeschriebene EWR-Niveau bzw. in Ermangelung eines solchen das liechtensteinische Niveau erfüllen, in Liechtenstein grenzüberschreitend tätig werden. Dieser allgemeine Grundsatz gilt für alle oben aufgeführten Bereiche, die ich vorher genannt hatte. Gravierende Auswirkungen aufgrund der Ausübung der Dienstleistungsfreiheit sind allgemein nicht zu erwarten. Im Gewerbe könnte es zu einem erhöhten Ausmass von grenzüberschreitenden Dienstleistungswerbern kommen. Allerdings kann auch hier davon ausgegangen werden, dass aufgrund der Erfahrungen nach dem EWR-Beitritt 1995 sich das Preisniveau der Dienstleistungen auf dem recht hohen liechtensteinischen Niveau einpendeln wird. Aufgrund des geltenden Entsendegesetzes kann zudem verhindert werden, dass über den Umweg der Ent-sendung von Arbeitnehmern aus den neuen EWR-Staaten Lohndumping betrieben wird, da gemäss diesem Gesetz Mindestlöhne vorgesehen sind.
Noch ein paar Bemerkungen zur Kapitalverkehrsfreiheit: Die jetzigen EWR-Bürger bzw. EWR-Gesellschaften können dieses Recht - das Recht der Kapitalverkehrsfreiheit in Liechtenstein seit dem Ablauf der Übergangsfrist 1997 - Wohnsitz in Liechtenstein ausüben. Dies hat – aufgrund der sehr hohen Grundstückspreise - nicht zu einer Investitionswelle in Liechtenstein geführt.
Was sind die Änderungen durch die EWR-Erweiterung? Neue EWR-Bürger bzw. Gesellschaften können ab 1. Mai 2005 in Liechtenstein unter den gleichen Bedingungen wie Liechtensteiner in Liechtenstein Investitionen tätigen bzw. Grund erwerben. Allerdings ist zum Grunderwerb durch die neuen EWR-Bürger auszuführen, dass das Grundverkehrsgesetz auf eine mindestens fünfjährige Aufenthaltsbewilligung, wovon bereits mindestens ein Jahr Wohnsitz im Inland bestanden haben muss, abstellt. Zum jetzigen Zeitpunkt kann dies kein neuer EWR-Bürger erfüllen, da ihnen – aufgrund des Drittstaatenregimes – immer nur Jahresaufenthaltsbewilligungen erteilt werden. Da die neuen EWR-Bürger für weitere zwei Jahre als Drittstaatsangehörige im Bezug auf die (erwerbstätige) Wohnsitznahme in Liechtenstein behandelt werden, wird der Druck auf dem Immobilienmarkt durch diese nicht gegeben sein. Der Kauf von Grundstücken zu Betriebszwecken ist allerdings durch die neuen EWR-Bürger ab 1. Mai 2004 möglich. Weiters können wohlhabende EWR-Bürger, die einen der 16 Quotenplätze für Nicht-Erwerbstätige in Liechtenstein erhalten haben, nach Ablauf eines Jahres Grund für Wohnzwecke erwerben.
Ich komme zum Abschluss zu einer Bewertung des EWR-Erweiterungsabkommens und zu einigen Ausführungen zur wirtschaftlichen und politischen Bewertung des EWR-Abkommens:
Aus wirtschaftlicher Sicht überwiegen die Vorteile der Erweiterung aus der Sicht der Regierung. Der Binnenmarkt mit seinen gemeinsamen Regeln vergrössert sich wesentlich. Die neuen Mitgliedstaaten zählen eher zu den Staaten, die höhere Wachstumsraten und ein Wirtschaftspotenzial aufweisen, das es von der Privatwirtschaft zu nutzen gilt.
Der erweiterte EWR wird die Chancen für die liechtensteinische Exportindustrie stärken. Dies wird es vermehrt auch dem Dienstleistungsbereich, vor allem auf dem Gebiet der Finanzdienstleistungen, möglich machen, neue Wege zu beschreiten und Märkte zu erschliessen. Hierzu ist der diskriminierungsfreie Zugang zu den Märkten eine Grundvoraussetzung. Auch der Abbau technischer Handelshemmnisse, die in derzeit abweichenden und komplizierten nationalen Regeln bestehen und die Möglichkeit der Beteiligung an öffentlichen Auftragsvergaben in den neuen Ländern sind grundsätzlich als positiv zu sehen.
Selbst wenn vornehmlich aufgrund von einzelnen Übergangsbestimmungen für einige Zeit in einigen Bereichen des Abkommens Asymmetrien bestehen werden, das heisst, insbesondere eine unterschiedliche Öffnung der Märkte erfolgen wird, ergeben sich daraus für Liechtenstein nach Einschätzung der Regierung keine wesentlichen spezifischen Probleme.
Die Regierung erwartet damit in vielen Bereichen keine oder nur geringe Probleme bei der Integration der neuen Mitglieder in den EWR, vorausgesetzt, sie erfüllen die mit der EU-Mitgliedschaft verbundenen Bedingungen. Andererseits wird durch die Öffnung der Märkte auch ein gewisser Druck auf die liechtensteinische Wirtschaft nicht auszuschliessen sein. Dieser Druck ist aber kaum quantifizierbar, wie dies grundsätzlich auch schon beim EWR-Beitritt Liechtensteins im Jahr 1995 nicht möglich war.
Wie im Bericht und Antrag dargelegt wurde, gab es vier für die EFTA-/EWR-Staaten spezifische Verhandlungsgegenstände, nämlich deren Finanzbeiträge, den Fischhandel für Island und Norwegen, die Quotenregelung im Landwirtschaftsbereich für Norwegen und die Personenverkehrslösung für Liechtenstein. Ich möchte kurz auf die Lösungen zum Personenverkehr und zu den Finanzbeiträgen zu sprechen kommen: Es ist erfreulich, dass es durch das EWR-Erweiterungsabkommen möglich war, die besondere Personenverkehrslösung für Liechtenstein besser zu verankern. Es kann kein Zweifel darüber bestehen, dass die neue Formulierung hinsichtlich der Dauer der Lösung - im Unterschied zur alten - grundsätzlich von einem Weiterbestehen der Sonderregelung nach dem Mai 2009 ausgeht, soweit weiterhin ein ähnlicher Immigrationsdruck anhält.
Für die Regierung ist in Bezug auf die EWR-Erweiterung von zentraler Bedeutung, dass die liechtensteinische Sonderlösung betreffend den Personenverkehr nicht nur verlängert, sondern auch rechtlich deutlich besser verankert werden konnte. Obwohl der EWR beinahe 500 Millionen Angehörige umfassen wird, kann Liechtenstein auch in Zukunft den Zuzug von EWR-Staatsangehörigen begrenzen. Die Quotenregelung sieht mindestens 56 Aufenthaltsgenehmigungen für Erwerbstätige und 16 für Nicht-Erwerbstätige im Jahr vor, davon je 50% im chancengleichen Auslosungsverfahren. Darüber hinaus konnte die bisherige zeitliche Begrenzung der Sonderlösung bis 2006 durch eine auf Dauer angelegte Lösung, die kein grundsätzliches Auslaufen der Sonderlösung mehr beinhaltet, ersetzt werden. Lediglich eine Überprüfung der Sonderlösung, welche alle fünf Jahre und erstmals vor Mai 2009 stattfinden wird, ist im EWR-Erweiterungsabkommen vorgesehen.
Die Regierung macht von der im EWR vorgesehenen Übergangsfrist hinsichtlich des Zugangs der neuen EWR-Staatsbürger zum nationalen Arbeitsmarkt für die ersten zwei Jahre Gebrauch, wie dies auch alle anderen EWR/EU-Staaten tun. Ob nach Ablauf dieser zweijährigen Übergangsfrist der liechtensteinische Arbeitsmarkt aufgrund der Möglichkeit einer gestaffelten weiteren Verlängerung der Übergangsfrist von bis zu fünf Jahren weiterhin geschützt werden soll, wird zum dannzumaligen Zeitpunkt zu entscheiden sein. Aufgrund der Anwendung des jetzigen Drittstaatenregimes auf die neuen EWR-Staatsangehörigen kann einer entsprechenden Nachfrage der Wirtschaft in Bezug auf qualifizierte Arbeitnehmer entsprochen werden. Die PVO, also die Personenverkehrsverordnung, sieht vor, dass Drittstaatsangehörige unter gewissen Voraussetzungen (Ausbildung, Praxis, Alter etc.) als Grenzgänger zum Beispiel in Österreich wohnen und im Inland mit einer Grenzgängermeldebestätigung arbeiten können. Österreich wird – nach den derzeitigen informellen Informationen - die reine Wohnsitznahme in Österreich zulassen.
Damit ist Ihre Frage beantwortet, Herr Abg. Hugo Quaderer. Beim Familiennachzug ändert sich der begünstigte Personenkreis der Angehörigen eines Quotenplatzinhabers durch die EWR-Erweiterung nicht. Damit können weiterhin die noch zu unterhaltenden Kinder bis zum 21. Lebensjahr und unterstützungswürdige Verwandte in auf- und absteigender Linie profitieren.
Während der Übergangsfrist kann Staatsangehörigen der neuen Mitgliedstaaten über die Erteilung einer Grenzgängerbewilligung bei entsprechender Ausbildung und Berufserfahrung der Zugang zum Arbeitsmarkt gewährt werden, wenn eine entsprechende Nachfrage seitens der liechtensteinischen Wirtschaft gegeben sein sollte.
In Bezug auf die geschäftliche Niederlassung in Liechtenstein sind die Staatsangehörigen der neuen Mitgliedstaaten bereits ab dem 1. Mai 2004 wie EWR-Staatsangehörige zu behandeln und können daher Niederlassungen gemäss Art. 31 EWRA - also ohne Wohnsitznahme in Liechtenstein - unter den gleichen Voraussetzungen wie liechtensteinische Staatsangehörige gründen.
Zur grenzüberschreitenden Dienstleistungserbringung ist auszuführen, dass Staatsangehörige der neuen Mitgliedstaaten gemäss Art. 36 EWR-Abkommen - übrigens wie die heutigen EWR-Staatsangehörigen - vorübergehend grenzüberschreitend in Liechtenstein tätig sein können, wenn sie in ihrem (EWR-)Heimat- bzw. Wohnsitzstaat rechtmässig tätig sind und die entsprechenden Melde- bzw. Anzeigevorschriften (Gewerbegesetz usw.) in Liechtenstein erfüllt haben.
Die Regierung rechnet nicht mit einem massiven Druck aus den neuen Mitgliedstaaten auf den Arbeitsmarkt, sie hat aber trotzdem über die spezifische Lösung für Liechtenstein im Bereich des Personenverkehrs und über die beschlossene Ausnutzung der Übergangsfrist betreffend den Zugang zum Arbeitsmarkt die notwendigen und die möglichen Vorkehrungen getroffen. Es kann aber nicht ausgeschlossen werden, dass die neuen Mitgliedstaaten längerfristig Bewegungen und Umschichtungen auf dem liechtensteinischen Arbeitsmarkt verursachen können. Dann zu den finanziellen Aspekten: Bei den EFTA-Finanzbeiträgen zur Reduktion der wirtschaftlichen und sozialen Ungleichheiten im EWR wurde schliesslich eine pragmatische Lösung zur Festlegung der Beiträge der EFTA-/EWR-Staaten gefunden. Dabei war die Bereitschaft Norwegens, auch auf bilateraler Ebene so genannte Kohäsionszahlungen für die Beitrittsländer zu leisten, ein äusserst hilfreiches Angebot, um die Verhandlungen zu einem Abschluss zu bringen. Aus Sicht der Regierung ist die Er-höhung der Beiträge auf das Fünffache ein akzeptabler Kompromiss. In Anbetracht der weit überproportionalen Ausdehnung armer Regionen durch die EWR-Erweiterung und des weit unterdurchschnittlichen Pro-Kopf-Einkommens in den Beitrittsländern stehen die neuen Zahlungsbeiträge in keinem krassen Missverhältnis zu den bisherigen Beiträgen. Da neue Finanzbeiträge ab 2009 der Zustimmung aller Vertragsparteien bedürfen, wird spätestens zu diesem Zeitpunkt eine Evaluation dieses Finanzinstruments im Lichte des Gesamtabkommens vorzunehmen sein.
Nun schliesslich die politische Gesamteinschätzung: Durch die Erweiterung wächst Europa weiter zusammen und es erhält damit auch eine weitere wichtige Grundlage für die europäische Friedensordnung. Gleichzeitig wird auch die Zusammenarbeit der EFTA-/EWR-Staaten mit diesen zehn Staaten auf eine neue und ausgebaute Grundlage gestellt, nachdem die Beziehungen bisher im Wesentlichen auf den Freihandelsabkommen im Rahmen der EFTA beruhten.
Ein stärkeres Zusammengehen und Überwinden der Grenzen baut Spannungen zwischen den beteiligten Staaten ab und ruft nach Dialog und Interessenausgleich. Dies wird, wie die bisherige Entwicklung zeigt, durchaus zu Friktionen in der Zusammenarbeit in der EU und damit möglicherweise auch im EWR führen können. Inwieweit die Erweiterung der EU und die damit verbundenen Frage der Vertiefung der Integration Auswirkungen auf den EWR haben werden, muss aber offen bleiben.
Das ist derzeit eine reine Einschätzung. Liechtenstein kann politisch aus der Erweiterung des EWR, die primär nach Osten erfolgt, Nutzen ziehen. Andererseits kann Liechtenstein im Rahmen des EWR-Erweiterungsabkommens auch einen Beitrag an die gesamteuropäische Solidarität leisten, was einer der Prioritäten der liechtensteinischen Aussenpolitik entspricht.
Die Regierung geht davon aus, dass die bilateralen Beziehungen Liechtensteins zu den zehn Beitrittsländern durch die EWR-Erweiterung neue Impulse erhalten werden. Die Regierung hofft, dass dies auch für die Beziehungen zwischen Liechtenstein, Tschechien und der Slowakei der Fall sein wird. Die Weigerung dieser beiden Länder, Liechtenstein als seit dem Jahr 1806 durchgehend souveränen Staat anzuerkennen, ist für die Regierung weiterhin ein wichtiges Thema, das der Lösung bedarf. Die Regierung hofft auch, dass sich Fortschritte in den bilateralen Beziehungen zu diesen beiden Ländern nicht zuletzt im Hinblick auf die enge Zusammenarbeit im Rahmen des EWR abzeichnen werden.
Dass die Position Liechtensteins aus völkerrechtlicher bzw. souveränitätspolitischer Sicht verbessert werden konnte, habe ich dargestellt. Der Regierung war es im Rahmen der Unterzeichnung des Abkommens nicht darum gegangen, das EWR-Abkommen oder dessen Erweiterung in Frage zu stellen, sondern die legitimen Interessen Liechtensteins zu vertreten. Die Regierung hat auch die Beschränkungen in der Aussenpolitik feststellen müssen. Der schmale aussenpolitische Apparat, der damit der Regierung und dem Land zur Verfügung steht, kam bei diesen Verhandlungen zwischen Oktober und November an seine Grenzen. Man sieht dort auch allein technisch und instrumentell, dass Liechtenstein eben Beschränkungen hat und auch nicht auf allen Ebenen tätig sein kann, sondern sich fokussieren muss. Neben der positiven Bewertung der EWR-Erweiterung - einschliesslich ihrer konkreten Bedingungen - erachtet es die Regierung auch als Vorteil, dass durch das Erweiterungsabkommen der EWR selbst eine Bestätigung als weiterhin gangbare und sinnvolle Integrationslösung erhält. Erfreulich ist schliesslich auch, dass die Paraphierung und Unterzeichnung des Abkommens unter liechtensteinischem EWR-Vorsitz stattgefunden hat.
Die Regierung beurteilt sowohl das EWR-Abkommen als auch die EWR-Erweiterung als ein Integrationsmodell für Liechtenstein, das aufgrund der derzeitigen Rahmenbedingungen grössenverträglich ist, die Souveränität Liechtensteins absichert und es Liechtenstein ermöglicht, am europäischen Aufbauwerk als vollwertiger Partner teilzunehmen und einen entsprechenden Beitrag zur europäischen Friedensordnung zu leisten.
Das EWR-Abkommen bringt Liechtenstein eine stabile vertragliche Grundlage für Beziehungen zur EU, die über die rein auf den Binnenmarkt bezogenen Regeln hinausgehen und Liechtenstein auch im internationalen Umfeld äusserst hilfreich sind. Dies hat sich auch in den verschiedenen Assessments - -ich erinnere an den IWF und an die OECD - gezeigt, die unter anderem durch den Verweis auf das in Liechtenstein anwendbare EWR-Recht und das damit einhergehende EWR/EU-Niveau positiv abgeschlossen werden konnten.
Andererseits ist damit auch nicht ausgeschlossen, dass unter dem Titel der europäischen Zusammenarbeit und ausserhalb des eigentlichen Deckungsbereichs des EWR-Abkommens bzw. des Erweiterungsabkommens Liechtenstein zur Zusammenarbeit mit der EU aufgefordert ist, wie dies zum Beispiel die Verhandlungen zur Zinsertragsbesteuerung eindrücklich zeigen. Liechtenstein wird sich daher auch weiterhin mit verschiedenen Fragestellungen befassen müssen, die ausserhalb der bisher vereinbarten Verträge liegen. Insofern entwickelt nicht nur der EWR selbst, sondern die Lage in Europa generell - zumindest in einzelnen Bereichen - eine eigene Dynamik und Liechtenstein wird sich diesen Herausforderungen stellen müssen.
Der EWR-Beitritt 1995 war mit vielen Hoffnungen und Ängsten verbunden. Die nun fast neunjährige EWR-Mitgliedschaft hat gezeigt, dass Liechtenstein als ein vollwertiger Partner auf europäischer Ebene anerkannt ist, einen wertvollen Beitrag zur Weiterentwicklung Europas leisten und vom EWR-Abkommen profitieren kann. Dabei ist unbestritten, dass Teile der liechtensteinischen Wirtschaft und Gesellschaft einen schmerzlichen Anpassungsprozess durchmachen mussten und müssen, um sich an die neue und verstärkte Konkurrenzsituation anzupassen. Auch die Landesverwaltung machte einen - notwendigen - Modernisierungsschub durch, der sich schlussendlich positiv auch auf die Bürgerinnen und Bürger ausgewirkt hat.
Da die Regierung die Vor- und Nachteile des EWR-Beitritts als positiv und als wichtigen Schritt gewertet hat, hat sie auch die EWR-Erweiterung von Anbeginn unterstützt. Das EWR-Abkommen sieht einen Automatismus für die neuen EU-Staaten bezüglich ihres Beitritts zum EWR-Abkommen vor. Die Haltung der Regierung war damit konsequent.
Beschönigen wir nichts - mit dem EWR wollen wir den Wettbewerb. Das EWR-System ist darauf ausgerichtet, dass es europaweit allen - wenn möglich gleich - besser geht. Geht es uns heute schon oder noch besser als anderen im System, müssen wir fest arbeiten, dass das so bleibt. Die EWR-Erweiterung soll in diesem Sinne nicht als Gefahr, sondern als Chance für Liechtenstein verstanden werden. Die liechtensteinischen Wirtschaftstreibenden sind aufgerufen, einerseits die sich bietenden Chancen zu nutzen, andererseits sich aber auch mit den Auswirkungen aus dem Abkommen auseinander zu setzen. Die Regierung ist überzeugt, dass sich Liechtenstein und alle Wirtschaftstreibenden in unserem Lande den damit verbunden Herausforderungen stellen können und auch in der Lage sind, sich diesen Herausforderungen erfolgreich zu stellen. Nach diesen Ausführungen kann ich noch ganz kurz zu einzelnen Fragen Stellung nehmen, die vielleicht noch nicht ganz ausgeleuchtet worden sind: Ich beginne beim Abg. Hugo Quaderer, der die Frage stellte, wie Liechtenstein die Position Norwegens zum EWR bzw. zu einem EU-Beitritt sieht und was das für allfällige Konsequenzen für Liechtenstein innerhalb des EWR hat: Nun, wie bekannt ist, gab es in Norwegen bereits zwei Abstimmungen zur Frage des EU-Beitrittes. Beide Abstimmungen verliefen negativ und in Norwegen ist man sehr vorsichtig, eine dritte Abstimmung - ohne ein sicheres Ergebnis zu kennen - in die Wege zu leiten. Die Umfragen in Norwegen geben je nach Zeitpunkt und Situation verschiedene Ergebnisse. Manchmal überwiegen die EU-Befürworter bis zu 60% vor knapp 2 Jahren, um dann wieder zu schwenken bis zu 45% für die Befürworter. Die Lage wird in Norwegen immer wieder davon abhängig gemacht werden und sein, wie sich die Umstände und die Bedingungen in der EU entwickeln. Sicherlich dadurch, dass Norwegen einen so grossen Kohäsionsfondsbeitrag zahlen muss, sind viele Stimmen laut geworden, die gesagt haben: Wenn wir schon so viel zahlen, ist es doch nahe liegender, auch den Beitritt und damit die Mitgliedschaft und die Abstimmungsrechte zu erhalten. Allerdings ist die Lage etwas komplizierter. Norwegen hat im nächsten Jahr Neuwahlen, die Regierung und das Parlament werden neu gewählt. Und man geht davon aus, dass diese Wahlen auch ein starkes Indiz dafür sein werden, in welche Richtung die Wähler einen EU-Beitritt oder nicht sehen. Wenn Norwegen der EU beitreten sollte, könnte dasselbe mit Island geschehen - muss aber nicht. Allerdings wäre aus unserer Sicht das jetzige EWR-System so nicht aufrechtzuerhalten. Man würde dann versuchen, das Abkommen - und ich sage das jetzt nur schemenmässig - würde man versuchen, das Abkommen mit der EU zu bi- oder trilateralisieren. Sicherlich hätte Liechtenstein und Island bei Ausfall der norwegischen Kohäsionszahlungen nicht die norwegischen Beiträge zu übernehmen. Selbstverständlich würden neue Verhandlungen stattfinden und sicherlich ist nicht davon auszugehen, dass Zahlungen in irgendeiner ähnlichen Grössenordnung, wie sie derzeit von Norwegen vertraglich zu tätigen sind, gemacht werden müssen.Dann nehme ich nicht mehr Stellung zur Frage des Herrn Landtagsvizepräsidenten über die Nützlichkeit und wo man die Stärkung Liechtensteins im Zusammenhang mit den Verhandlungen Tschechien/Slowakei sieht. Ich habe Schwerpunkte angegeben. Die Realität ist in der Tat so, dass wir intern immer wieder Unterstützung haben und grosses Verständnis für unsere Belange. Und das war nur durch diesen kurzfristigen sehr intensiven Einsatz auf der diplomatischen Ebene möglich. Natürlich, wenn der Landtagsvizepräsident feststellt, dass - vielleicht vorher nicht ausgedrückt im Bericht und Antrag - es Liechtenstein bewusst war, dass das Zeitfenster kein grosses ist, möchte ich einfach in Erinnerung rufen: Das war uns selbstverständlich bewusst, aber wir hätten das natürlich nie in der Öffentlichkeit gesagt. Wichtig ist in diesem Zusammenhang - denn das ist ein Verhandlungsargument, ein strategisches Argument - wichtig ist in diesem Zusammenhang, dass die ganzen Zeitfenster mit den anderen EWR-/EFTA-Staaten vorgängig abgesprochen waren. Das ist das Entscheidende und dass man natürlich diese Absprachen nicht nach aussen tragen wollte, weil damit die ganze Strategie zusammengefallen wäre. Und vor diesem Hintergrund wird auch verständlich, weshalb man jetzt diese Formulierung, wie sie im Bericht und Antrag verwendet wurde, benutzen konnte.Ich lasse es hiermit gelten. Wenn ein Abgeordneter oder eine Abgeordnete nicht genügend Informationen bekommen hat, stehe ich zur Verfügung. Danke schön.Abg. Peter Sprenger:
Herr Aussenminister, herzlichen Dank für Ihre sehr umfangreichen und ausführlichen Ausführungen. Ich habe Ihnen durchgehend und aufmerksam zugehört und habe dabei bemerkt, dass Sie ein denkwürdiges Datum, nämlich den Mittwoch, den 8.10. 2003 - ich unterstelle mal - geflissentlich ausgeklammert haben. Dazu habe ich lediglich zwei Fragen: Die erste Frage lautet: Ist es richtig, dass Sie in der APK-Sitzung vom 8.10.2003, um 8.00 Uhr morgens, unmissverständlich zum Ausdruck brachten, dass die Regierung beabsichtige, das EWR-Erweiterungsabkommen zum vorgesehenen Zeitpunkt, nämlich am 13./14.10. des vergangenen Jahres zu unterzeichnen, und dass diese Absicht in der sich daran anschliessenden Besprechung mit dem Fürsten um 10 Uhr desselben Tages ins Gegenteil umschlug?Die zweite Frage: Was war der Grund Ihres Gesinnungswandels, der auch derjenige der Regierung war?Abg. Ingrid Hassler-Gerner:
Auch ich habe mich bei Herrn Regierungsrat Walch für die ausführlichen und genauen Ausführungen zu bedanken. Ich habe erfahren, dass meine Frage in der APK Ihrem Amt bzw. Ihren Mitarbeitern Arbeit bereitet hat. Ich möchte vorschlagen, dass Sie die nicht vorgetragenen detaillierteren Ausführungen noch vielleicht dem Landtag in geeigneter Form schriftlich nachreichen können. Es wäre ja schade um diese detaillierte Arbeit über die Zulassung, vor allem jene der freien Berufe, die ja immer wieder ein bisschen einen anderen Umstand als die Arbeitnehmer haben.Eine Frage habe ich nicht aufgeworfen, und zwar die Frage: Wie sind die Ausbildungsstandards der Arbeitnehmer in diesen Ländern vergleichbar mit den hiesigen Ausbildungsstandards, das heisst, wie wurde das Problem der Anerkennung von Diplomen und anderen Abschlüssen für die Zulassung gemäss unserer nationalen Gesetzgebung geregelt? Gibt es diesbezüglich eine Harmonie, dass man diese gleichwertig anerkennt oder nicht?Bei weiteren Ausführungen über den Zugang von Unternehmen habe ich Sie so verstanden, dass Mindestlöhne, sollte man sie hier haben, eigentlich auch vor dem Zustrom von Unternehmen schützen. Das heisst, Mindestlöhne können in dem Fall auch auf der Seite ein Regulativ sein. Eine Unklarheit ist entstanden. Ich erlaube mir, die Zeit zu beanspruchen, dies noch genau zu erfahren: Ich habe in meinem Votum auf Seite 55 den untersten Absatz praktisch wörtlich zitiert, wo es heisst: «Es ist auch hervorzuheben, dass während der Übergangsfrist Staatsangehörigen der neuen Mitgliedstaaten über die Erteilung einer Grenzgängerbewilligung bei entsprechender Ausbildung und Berufserfahrung der Zugang zum Arbeitsmarkt gewährt werden kann», wenn die liechtensteinische Wirtschaft eine Nachfrage stellt. Ich habe Sie so verstanden, dass der Zugang während der Übergangsfrist von zwei, allenfalls drei weiteren Jahren - vielleicht sogar sieben Jahre - für Wohnsitz und der Zugang zum Arbeitsmarkt noch gesperrt bleibt. Heisst das «werden kann», dass die Regierung trotzdem frei ist, auf Wunsch von gewissen Industrien oder Gewerbebetrieben die Zulassung als Grenzgänger zu erteilen, obwohl grundsätzlich gesagt wird, dass durch die Übergangsfrist der Zugang geschützt ist? Das liegt dann also ganz in der Hand von uns, das heisst: Wir dürfen, aber wir müssen nicht. Ich habe das jedenfalls so verstanden. Ob das dann ideal ist für uns, wenn man dann vom Schutz und Zugang zum Arbeitsmarkt spricht, das würde ich etwas bezweifeln. Eine weitere Frage ist noch der Zugang von Liechtensteinern bei allen Universitäten in diesen Ländern, die auch über spezifische Universitäten verfügen. Vielleicht ist die Sprache manchmal ein Problem, aber sehr oft wird jetzt ja auch in der englischen Sprache unterrichtet. Ist dieser Zugang in all diesen Ländern somit gewährleistet? Und die letzte Frage, die mich noch interessiert: Wie sieht man eigentlich allgemein die weitere Erweiterung der Europäischen Union? Ich denke jetzt hier natürlich nicht an die Schweiz und auch nicht an die Türkei, sondern eher an andere Staaten. Aber gibt es schon Vorstellungen, wie die EU respektive demzufolge dann auch der EWR-Vertrag auf ein weiteres Kontingent von Beitrittskandidaten und Ländern angewendet werden könnte? Wie sieht man das bei der EU aktuell?Abg. Ivo Klein:
Auch ich möchte mich für die sehr umfangreichen Ausführungen bedanken. Ich möchte nur einen Bogen spannen, und zwar zum Traktandum von heute Morgen bezüglich Interpellationsbeantwortung «Arbeitslosigkeit». Da haben wir ja gesehen, dass einerseits die Zahl der Arbeitsplätze in Liechtenstein wieder steigt, andererseits aber gleichzeitig auch die Arbeitslosigkeit in Liechtenstein tendenziell nach oben zeigt. Der Grund ist klar: Wir haben eine grössere Anzahl Grenzgänger. Mit dieser Erweiterung werden wir nach den Übergangsfristen, seien die jetzt zwei Jahre oder dann mehr, ein grösseres Potenzial haben. Sie haben dann sinngemäss bei den allgemeinen Ausführungen bezüglich der Gefahr des Lohndumpings ausgeführt, dass die EWR-Richtlinien die Möglichkeit von Mindestlöhnen ja geben und dadurch dieses Problem behoben werden kann. Tatsache ist in Liechtenstein: Wir haben solche gesetzlichen Regelungen nicht. Wir haben sie zum Teil, aber auch nur zum Teil, im Rahmen von Gesamtarbeitsverträgen. Aber gesetzliche Regelungen haben wir nicht. Also, viele Arbeitnehmerinnen und Arbeitnehmer werden dann auch wieder dieser Gefahr ausgesetzt sein, falls wir bis dann keine solchen gesetzlichen Bestimmungen haben. Darauf möchte ich hinweisen. Und ich erachte es als notwendig, dass wir zu diesem Thema wirklich das mal anschauen, die Vor- und Nachteile abwiegen und dann zu einem Entschluss kommen. Ich könnte mir vorstellen, dass hier Handlungsbedarf besteht. Danke.Regierungsrat Ernst Walch:
Herr Präsident, meine Damen und Herren. Ich beginne bei den letzten Ausführungen, also mit den Ausführungen des Abg. Ivo Klein. Ich danke für den Hinweis. Ich möchte doch darauf hinweisen: Richtig, es gibt Gesamtarbeitsverträge und vor allem gibt es, wo das grösste Lohndumping in der Pra-xis stattfinden kann, ein Entsendegesetz. Das sind Richtlinien, die Liechtenstein umgesetzt hat und die verhindern, dass Temporärarbeiter, die von anderen Unternehmen nach Liechtenstein geschickt werden, dass die nicht den Mindestlohn-Richtlinien unterstehen. Was nach EWR-Recht möglich ist, hat Liechtenstein diesbezüglich gemacht. Man müsste sich vielleicht auch fragen - ich will die Diskussion von heute Morgen sicher nicht aufwärmen, das ist nicht der Zeitpunkt dazu - man müsste sich halt allenfalls fragen, ob man die Arbeitslosengesetzgebung auch entsprechend abändern kann, um diesen teilweise auch Auswüchsen etwas Herr zu werden oder diese eindämmen zu können.Wenn ich weiter zurückgehe zu den Bemerkungen bzw. Fragen: Die Abg. Ingrid Hassler hat nach allgemeinen Erweiterungsplänen, Absichten oder Überlegungen der EU ausserhalb der Türkei und der Schweiz gefragt: Wo eine Erweiterung sicher stattfinden wird, sofern die jetzigen wirtschaftlichen und politischen Gegebenheiten fortgeschrieben werden, ist nach Bulgarien und Rumänien. Ich nehme an, obwohl noch kein informelles Gesuch steht, allenfalls auch Kroatien. Dieses Land ist vielleicht weiter fortgeschritten und EU-tauglich in diesem Sinne als vielleicht Rumänien oder Bulgarien. Jedenfalls haben die ihre Mitgliedschaftsbewerbungen angemeldet und sie erwarten, dass sie, wenn ich das richtig im Kopf habe, per 2007 Mitglied der EU werden können und sollen. Das würde natürlich auch eine entsprechende wahrscheinlich formelle Anpassung des EWR bedeuten. Diese Erweiterung ist, zumindest im derzeitigen Stand der Dinge, absehbar. Was die Universitäten anlangt: Dieser Zugang ist natürlich durch das EWR-Abkommen auch auf die Universitäten in diesen neuen Ländern gesichert. Der Zugang ist also gegeben und gewährleistet. Ihre Interpretationen zu den Ausführungen der Regierung im Bericht und Antrag zu Seite 55 sind richtig. Bei entsprechendem Bedarf kann ja Liechtenstein selbst entsprechende Bewilligungen erteilen. Die Möglichkeit besteht also, allerdings vor dem Hintergrund der Gleichbehandlung und der Nicht-Verzerrung des Arbeitsmarktes. Vor dem Hintergrund der Gleichbehandlung - auch unter den verschiedenen Wirtschaftszweigen - wird die Regierung diese Frage restriktiv auslegen. Allerdings, wenn halt die Wirtschaft die qualifiziertesten Arbeitskräfte in diesen Bereichen braucht, dann wird die Möglichkeit grundsätzlich auch bestehen. Was den Ausbildungsstandard der Arbeitnehmer oder der EWR-Mitglieder in den neuen Staaten anlangt, kann ich so keine Ausführungen machen. Es wäre Allgemeinwissen oder das was man liest. Ich kann das nicht machen, ich weiss es einfach nicht. Man sagt, dass in Oststaaten die naturwissenschaftliche Ausbildung im Durchschnitt höher als bei uns ist. Die Naturwissenschaften werden stärker bevorzugt als die sprachlichen Fächer. Dies zumindest im Vergleich. Aber daraus Schlüsse zu ziehen, dass für die verschiedenen Gewerbearten, für die verschiedenen Branchen und Sparten, eine bessere oder schlechtere Ausbildung besteht, das wage ich nicht zu sagen.Was die Ausführungen in Bezug auf die verschiedenen Branchen anlangt, und Sie, Frau Abgeordnete Hassler den Vorschlag machen, dass diese Unterlagen dem Landtag schriftlich nachgereicht werden können, möchte ich mir doch erlauben, diese Ausführungen zu lesen, in die Landtagsprotokolle zu bringen und damit auch für die interessierte Öffentlichkeit zugänglich zu machen, weil es ja die verschiedenen Sparten betrifft. Ich möchte das Ganze vielleicht etwas abgekürzt machen, aber doch die wesentlichen Punkte darlegen:Bezüglich der Ärzte kann ich Folgendes festhalten: Trotz des Erfordernisses des Nachweises des hohen EWR-Ausbildungs- und Praxisniveaus hat sich die Zahl der in Liechtenstein niedergelassenen Ärzte nach Ende der Übergangsfrist per 1. Januar 1998 verdoppelt, von 33 auf 66 Ärzte. Dies lag einerseits am äusserst liberalen Zulassungs-, als auch am grosszügigen Abgeltungs- und Kostenrefundierungssystems, das den liechtensteinischen Gesundheitsmarkt für EWR-Ärzte, die sich in ihren Heimatländern mit strikten Kassenarztzulassungssystem konfrontiert gesehen haben, attraktiv gemacht hat. Das 1996 eingeführte Verbot der Führung von Zweitpraxen konnte den Zustrom der EWR-Ärzte nicht wirksam eindämmen. Nach der durch die Rechtsprechung des EFTA-Gerichtshofs notwendig gewordenen Abschaffung des Verbots von Zweitpraxen lagen binnen weniger Tage mehr als 20 neue Anträ-ge zur Praxiseröffnung vor. Daher musste ein auf zwei Jahre befristetes Moratorium bis Ende 2003 eingeführt werden, damit das liberale Zulassungssystem durch ein in Deutschland und Österreich nachgebildetes Kassenarztsystem ersetzt werden konnte. Dies geschah durch die Abänderung des KVG, des Sanitätsgesetzes und die Schaffung eines neuen Ärztegesetzes. Durch diese Gesetzesänderung wird die Niederlassungsfreiheit der Ärzte in Liechtenstein nicht beschränkt, allerdings ist die Aufnahme in das Gesundheitsnetz Liechtenstein an eine Bedarfsprüfung geknüpft. Durch diese soll die optimale Gesundheitsversorgung und eine Über- bzw. Unterversorgung Liechtensteins in gewissen Fachdisziplinen verhindert werden. Aufgrund der geänderten gesetzlichen Rahmenbedingungen wird es nach der EWR-Erweiterung zu keinem rasanten Anstieg der EWR-Ärzte kommen, da die Attraktivität des liechtensteinischen Gesundheitsmarktes durch die Bedarfsprüfung wesentlich gemindert werden kann.Bezüglich der Zahnärzte gilt das zu den Ärzten Ausgeführte. Da die Kostenrefundierungen der Zahnbehandlungen nur im Krankheitsfall übernommen werden, war nach der Abschaffung des Verbots der Zweitpraxen kein Moratorium notwendig, obwohl die Zahl der Zahnärzte von 15 um ein Drittel zugenommen hat. Die Zahnärzte sind weiterhin im Sanitätsgesetz geregelt. Eine Aufnahme ins Gesundheitsnetz Liechtenstein ist für diese bekanntlich nicht vorgesehen. Ob es nach dem EWR-Beitritt der zehn Staaten zu einem Anstieg der EWR-Zahnärzte aus den neuen EWR-Staaten kommen wird ist fraglich, da in Europa allgemein eine weitergehende Kostenrefundierung von Zahnbehandlungen als in Liechtenstein erfolgt. Diese Information an die Antragsteller könnte diese von der effektiven Antragstellung abhalten. In Bezug auf nichtakademische Ausbildungen im Medizinalbereich, also Physiotherapeuten, Masseure, Krankenschwestern und Hebammen gilt auch da grundsätzlich das zu den Ärzten Ausgeführte. Da nach Ablauf der Übergangsfrist die Zahl der Physiotherapeuten von 15 auf 31 mehr als verdoppelt bzw. der Masseure über ein Drittel zugenommen hat, ist nach den Gesetzesrevisionen auch für diese zwei Bereiche - wie bei den Ärzten - eine Bedarfsplanung vorgesehen. Bei den anderen medizinischen Berufen - Krankenschwestern und Hebammen - ist die Zahl der selbstständig Tätigen nicht so rasch gestiegen, sodass derzeit keine Bedarfsplanung vorgesehen ist. In Bezug auf die Erweiterung ergeben sich auch keine Änderungen.In Bezug auf Rechtsanwälte möchte ich Folgendes ausführen: Im EWR bereits niedergelassene Rechtsanwälte können sich gemäss der Richtlinie erleichtert in einem anderen EWR-Staat niederlassen und dort die gleichen Tätigkeiten wie ein inländischer Rechtsanwalt ausüben. Die einzige Einschränkung besteht darin, dass sich dieser EWR-Rechtsanwalt in den ersten drei Jahren, zum Beispiel Dr. XY, «deutscher Rechtsanwalt» nennt. Nach diesen drei Jahren kann er einen Antrag auf die Eintragung in die liechtensteinische Rechtsanwaltsliste stellen. Um zu verhindern, dass EWR-Anwälte treuhandähnliche Geschäfte erleichtert anbieten dürfen, musste das Rechtsanwaltsgesetz entsprechend geändert werden, um eine Trennung der Berufe des Rechtsanwalts einerseits und des Treuhänders andererseits durchzuführen. Von der Möglichkeit der Eintragung in das EWR-Rechtsanwaltsregister haben bis heute 13 EWR-Rechtsanwälte Gebrauch gemacht. Weiters können Rechtsanwälte von der Rechtsanwaltsdienstleistungs-Richtlinie profitieren und ihre Mandanten auch in einem anderen EWR-Staat bei Gericht nach vorheriger Meldung bei der zuständigen Stelle - bei uns ist das die Rechtsanwaltskammer - rechtswirksam vertreten. Ein Ansturm auf Liechtenstein ist hier ausgeblieben, was wahrscheinlich nicht zuletzt mögliche Haftungsrisiken widerspiegelt. 16 EWR-Rechtsanwälte haben in Liechtenstein ihre Anwaltsausbildung und anschliessend die liechtensteinische Anwaltsprüfung abgelegt. Das allein in den Jahren 2001 und 2002. Dies auch deshalb, weil die in ihrem Heimatstaat vorgeschriebene Konzipiententätigkeit doppelt so lang bzw. noch länger als in Liechtenstein dauern würde. Die Ausführungen zur EWR-Erweiterung und den Ärzten gelten analog. Der Ansturm - wenn wir von Verdoppelung und mehr von Zahlen sprechen - der Ansturm von EWR-Rechtsanwälten aus den neuen EWR-Staaten wird sich aufgrund wahrscheinlich der Sprachbarriere schon und der verschiedenen Rechtstraditionen höchstwahrscheinlich im Rahmen halten. Wesentlich stärker ist der Druck aus den Nachbarländern Österreich und Deutschland. Das hat übrigens auch seine Auswirkungen alleine schon auf die Frage des Gerichtspraktikums, wo aufgrund der vielen Anmeldungen, die gleich behandelt werden müssen, seien sie inländisch oder ausländisch, eben diese Ausbildungsplätze zur Verfügung gestellt werden müssen. Derzeit ist es leider so, dass man bei einer Anmeldung drei bis vier Jahre warten muss, bis man überhaupt einen Platz beim Landgericht hat. Das ist eine der Auswirkungen des EWR. Mit der Erweiterung sieht die Regierung aufgrund der Sprachbarrieren und den doch recht unterschiedlichen Systemen keinen grösseren Ansturm mehr.Grundsätzlich gilt für die Architekten das Gleiche wie bei den Ärzten. Die Zahl der EWR-Architekten ist nach Ablauf der Übergangsfrist auf insgesamt 177 angestiegen. Allerdings ist die Zahl jener Architekten, die tatsächlich eine geschäftliche Niederlassung im Inland haben, wesentlich geringer. Aufgrund einer fehlerhaften Auslegung des Ingenieur- und Architektengesetzes durch das früher zuständige Amt wurde nicht zwischen der Niederlassungs- und der Dienstleistungsfreiheit unterschieden. Eine Bereinigung durch das nun zuständige Hochbauamt wird laufend durchgeführt. Die Ausführungen zur EWR-Erweiterung und den Ärzten gelten analog. Der Ansturm von EWR-Architekten aus den neuen EWR-Staaten wird sich - so ist die Einschätzung aufgrund der Sprachbarriere - im Rahmen halten. Übrigens ist die Anerkennung der Architektenausbildung an der Fachhochschule Liechtenstein europaweit anerkannt, somit auch in den neuen EU- bzw. EWR-Ländern.Für das Transportgewerbe gilt Folgendes: Beim EWR-Beitritt hat es zirka 400 LKWs mit FL-Kennzeichen gegeben, welche grösstenteils nicht in Liechtenstein parkiert waren. Nach dem EWR-Beitritt ist die Zahl der FL-LKWs auf 600 gestiegen, was zu einer Anpassung der gesetzlichen Rahmenbedingungen durch eine Abänderung des Gewerbegesetzes geführt hat. Dadurch war die Voraussetzung einer entsprechenden Betriebsstätte im Inland und einer verstärkten Kontrolle der EWR-Zweigniederlassungen von EWR-Transportunternehmen in Liechtenstein nötig bzw. überhaupt erst möglich. Die Zahl der LKWs mit FL-Plaketten ist zwischenzeitlich wieder auf zirka 400 gesunken. Ein Ansturm von EWR-Transportunternehmern aus den neuen EWR-Staaten wird sich aufgrund der gesetzlichen Rahmenbedingungen und der verstärkten Kontrollen im Rahmen halten.Ein paar Bemerkungen noch zum Gewerbe: Beim EWR-Beitritt befürchtete man einen Zustrom von Gewerbebetrieben aus dem EWR. Dieser Zustrom war zwar gegeben, aber nie in dem erwarteten Ausmass. Seit dem EWR-Beitritt werden im Jahr durchschnittlich zirka 350 bis 400 Gewerbebewilligungen erteilt, wie ich schon ausgeführt habe. Insgesamt gibt es in Liechtenstein derzeit zirka 4'000 Gewerbebetriebe. Diese Bewilligungen können aber nur erteilt werden, wenn der Gewerbeinhaber bzw. der gewerberechtliche Geschäftsführer über die entsprechenden Ausbildungs- und Praxiserfordernisse verfügt und der Nachweis einer entsprechenden Betriebsstätte erbracht wird. Mit diesen gesetzlichen Rahmenbedingungen ist es gelungen, den Gewerbestandort Liechtenstein attraktiv, aber nicht zu attraktiv zu gestalten. Das durch die Entscheidung des EFTA-Gerichtshofs unter «Rainford-Towning» bekannte abzuschaffende Wohnsitzerfordernis des gewerberechtlichen Geschäftsführers im Inland hat nicht zu einem Anstieg der Gewerbegründungen geführt. Allerdings werden viele FL-Gewerbe durch nicht in Liechtenstein wohnhafte Geschäftsführer geführt. Derzeit wohnen zirka 25 bis 30% der gewerberechtlichen Geschäftsführer ausserhalb Liechtensteins. Nach der EWR-Erweiterung ist nicht mit einem raschen Anstieg von Gewerbebetrieben aus den neuen EWR-Staaten zu rechnen, da diese einerseits das Ausbildungs- und Praxisniveau nachweisen und andererseits über eine entsprechende inländische Betriebsstätte verfügen müssen. Weiters ist es einem neuen EWR-Bürger zwar möglich, eine Einzelfirma zu gründen, Arbeitnehmer aus den neuen EWR-Staaten können aufgrund der Übergangsfrist nicht bzw. nur äusserst beschränkt beschäftigt werden. Ein Ausweichen, also ein Lohndumping über die Entsendung zum Beispiel von kostengünstigeren polnischen Leiharbeitern des polnischen Stammbetriebs an die inländische Zweigniederlassung ist aufgrund des zur Anwendung kommenden Entsendegesetzes - auf das ich schon hingewiesen habe - mit den dort vorgeschriebenen Mindestlöhnen nicht möglich.Noch ein paar Worte zu den Banken und dem Finanzdienstleistungsbereich: Die Niederlassung von Finanzdienstleistungsunternehmen und Banken aus den neuen EWR-Staaten ist in Liechtenstein unter Beachtung der anwendbaren Spezialgesetze selbstverständlich - Bankengesetz, Investmentunternehmensgesetz usw. - möglich, allerdings nur, wenn alle Voraussetzungen fachlicher und personeller Art erfüllt sind. Da aufgrund der Übergangsfrist keine neuen EWR-Bürger als Arbeitnehmer angestellt werden können, daher auch nicht als Geschäftsführer, sind Liechtensteiner oder jetzige EWR-Bürger zu rekrutieren, was sich kostenmässig entsprechend niederschlagen wird. Aufgrund der jetzigen konjunkturellen Situation des liechtensteinischen Bankenplatzes ist nicht mit einer neuen Bankenwelle zu rechnen. Der stark wachsende inländische und von der Regierung auch forcierte Fondsplatz hat durch die EWR-Erweiterung allerdings zusätzlich die Chance, vom grösseren Fondsmarkt zu profitieren.Bezüglich Versicherungen hat es sich gezeigt, dass der inländische Markt für schweizerische Versicherungsunternehmen sehr interessant, für Versicherungsunternehmen aus dem EWR-Raum aber weniger interessant ist. Das spiegelt sich auch in der äusserst geringen Zahl der EWR-Tochterfirmen von EWR-Versicherungen wider. Nach der EWR-Erweiterung ist daher nicht mit einem Ansturm von EWR-Versicherungsunternehmen aus den neuen EWR-Staaten zu rechnen. Übrigens gilt bezüglich der einzustellenden Arbeitnehmer das zu den Banken Gesagte.Ich hoffe, diese Ausführungen decken die meisten wichtigen interessierenden Branchen ab.Dann habe ich noch eine Frage des Abg. Peter Sprenger zu beantworten. Er fragte nach dem Datum des 8. Oktober 2003: Ihre Annahmen sind nicht richtig. Die Regierung hat die Positionen nicht gewechselt. Wir haben zu jenem Zeitpunkt immer klar festgehalten, dass wir den Vertrag unterschreiben, wenn die entsprechende Anerkennung gegeben ist bzw. wenn auf unsere Erklärung keine Gegenerklärung folge. Ich erinnere: Die Gegenerklärung, die inhaltlich auf die von Liechtenstein verlangte integrale Anerkennung - um dieses Schwammwort zu verwenden - folgte, diese Gegenerklärung hat ja die Tschechei und die Slowakei erst am 9. abgegeben, und zwar am Abend des 9. Das hat auch nichts zu tun gehabt mit der Sitzung bzw. mit den Abklärungen und Besprechungen mit dem Fürstenhaus. Diese Diskussionen, nachdem sie aussenpolitischer Natur sind, haben laufend stattgefunden und das hatte gar nichts damit zu tun, dass das mit einem Gesinnungswandel wegen eines Besuches auf dem Schloss nach der APK-Sitzung zu tun hätte. Das war gar nicht der Fall, sondern es wurden alle Möglichkeiten besprochen und es wurde gesagt: Je nachdem, wie sich die beiden Staaten verhalten, wird Liechtenstein die Konsequenzen ziehen. Das Tragische an dieser ganzen Sache im Umfeld des 14. Oktober 2003 und der Unterzeichnung war letztlich, dass eigentlich die EU-Kommission und noch viel mehr das Vorsitzland Italien und verschiedene Staaten einerseits unsere Aide-mémoires und unsere Erklärungen nicht zur Kenntnis genommen haben oder nicht zur Kenntnis nehmen wollten, und insbesondere nicht geglaubt haben, dass wir das, was wir vorlegen, auch durchführen. Das war die grosse Überraschung. Sie haben es völlig unterschätzt, dass wir die Konsequenz, die wir schriftlich deponiert haben, auch ziehen. Das war die grosse Überraschung. Und dann kamen die Aha-Erlebnisse. Es waren die Isländer und die Norweger, die von Anfang an erkannt haben, dass wir es ernst meinen und sie haben sich deswegen auch von Anfang an in Solidarität hinter unsere Sache gestellt.Landtagspräsident Klaus Wanger:
