Wir kommen zu Traktandum 6: Interpellation zum Umgang mit Cannabis in Liechtenstein der Abgeordneten Georg Kaufmann, Thomas Lageder und Patrick Risch vom 29. Januar 2018. Wird seitens der Interpellanten das Wort gewünscht? Abg. Georg Kaufmann
Besten Dank für das Wort, Herr Präsident. Gestützt auf Art. 45 der Geschäftsordnung für den liechtensteinischen Landtag reichen die unterzeichneten Abgeordneten eine Interpellation ein und laden die Regierung ein, nachfolgende Fragen zum Umgang mit Cannabis in Liechtenstein zu beantworten. - Welche Kosten entstanden in den vergangenen fünf Jahren für die strafrechtliche Verfolgung und für auferlegte Massnahmen für Konsumentinnen und Konsumenten von Cannabis?
- Welche Kosten entstehen durchschnittlich pro Konsumentin beziehungsweise Konsumenten?
- Wie beurteilt die Regierung die Wirkung der in Liechtenstein bei Konsumentinnen und Konsumenten zur Anwendung gelangten Massnahmen, um den Konsum von Cannabis einzuschränken?
- Erlaubt die internationale Einbindung Liechtensteins, beim Besitz von Cannabis in einer Menge, bei der davon ausgegangen werden kann, dass sie für den Eigengebrauch und nicht für den Verkauf bestimmt ist, von einer strafrechtlichen Verfolgung abzusehen und stattdessen eine Ordnungsbusse einzuführen?
- Welche Möglichkeiten der Regulierung hat der Staat, wenn der Umgang mit Cannabis zwar nicht strafrechtlich verfolgt wird, Cannabis aber nicht grundsätzlich legalisiert wird?
- Welche Konsequenzen erwartet die Regierung von einer Umwandlung einer Strafverfolgung in eine Ordnungsbusse?
- Wie hoch schätzt die Regierung die volkswirtschaftlichen Kosten von missbräuchlichem Cannabis-Konsum ein und wie werden sich diese nach der Erwartung der Regierung entwickeln, wenn der Konsum entkriminalisiert werden würde?
- Welche Hürden haben Schmerzpatientinnen und -patienten beziehungsweise Ärztinnen und Ärzte, die ihren Patientinnen oder Patienten Cannabis-Arzneimittel zur Schmerzlinderung verschreiben möchten, zu überwinden, um Cannabis als Heilmittel anzuwenden? Wer kommt für die Kosten auf? Sind diese durch die OKP-Versicherung abgedeckt?
- Welche Möglichkeiten hat Liechtenstein, diese Hürden abzubauen?
- Welche Möglichkeiten hat Liechtenstein, die Forschung zur medizinischen Anwendung von Cannabis zu fördern und zu erleichtern?
Wir begründen diese Fragen folgendermassen: Der Konsum psychotroper Substanzen birgt ein Gesundheitsrisiko, das durch die Gefahren einer Abhängigkeit verschärft wird. Um die Gesellschaft vor den Konsequenzen von missbräuchlichem Konsum zu schützen, hat sich allgemein die Überzeugung durch-gesetzt, den Konsum und damit zusammenhängende Bereiche zu regulieren. Beispielsweise wurde die Bewerbung von Alkohol und Tabak eingeschränkt, die Abgabe von starken Schmerzmitteln durch Ärzte und Apotheken wird kontrolliert, es gibt Jugendschutzvorschriften, das Führen eines Motorfahrzeugs unter dem Einfluss von psychotropen Stoffen wird sanktioniert und verschiedene weitere Massnahmen. Die weiteren Massnahmen umfassen insbesondere Verbote, die bei Nichtbefolgung strafrechtliche Konsequenzen nach sich ziehen. Die Konzentration auf repressive Massnahmen zeigt sich deutlich an den internationalen Übereinkommen, die Liechtenstein ratifiziert hat. Die Konzentration auf repressive Massnahmen wurde sogar verstärkt. Grundsätzlich ist jeglicher Verkehr mit psychotropen Stoffen zu verbieten, die von den Vereinten Nationen aufgelistet werden, sofern sie nicht medizinischen Zwecken dienen. Entgegen dem Einheits-Übereinkommen von 1961 über die Betäubungsmittel ist beim Übereinkommen der Vereinten Nationen gegen den unerlaubten Verkehr mit Betäubungsmitteln und psychotropen Stoffen (abgeschlossen 1988) auch der Besitz, der Kauf oder der Anbau von Betäubungsmitteln für den Eigengebrauch mit strafrechtlichen Sanktionen zu belegen.Bereits im vergangenen Jahrhundert verstärkten sich aber Zweifel, dass eine auf Repression setzende Drogenpolitik in jedem Fall sinnvoll ist. Liechtenstein hat entsprechend zur Forderung, auch den Besitz von Betäubungsmitteln für den Eigenverbrauch strafrechtlich zu verfolgen, bei den Vereinten Nationen einen mit der Schweiz gleichlautenden Vorbehalt hinterlegt, sich an diese Verschärfung nicht gebunden zu fühlen. Mit den oben angeführten Fragen möchten die Interpellanten klären, wie die Regierung angesichts der internationalen Tendenz zur Rücknahme repressiver Massnahmen die strafrechtliche Verfolgung von Konsumentinnen und Konsumenten der sogenannten weichen Droge Cannabis in Liechtenstein beurteilt. Die Interpellanten bitten die Regierung, dazu einen Überblick über die in Liechtenstein gewonnenen Erkenntnisse zu geben, die es erlauben, verschiedene Massnahmen zu beurteilen. Da der Handel mit psychotropen Stoffen international reguliert ist und Liechtenstein des Weiteren wirtschaftlich mit der Schweiz und dem EWR eng verbunden ist, stellt sich auch die Frage, wie weit Liechtenstein seine Drogenpolitik autonom gestalten kann.Eine Kosten-Nutzen-Analyse ist sicher nicht so einfach durchzuführen, dass damit die Frage, wie mit Cannabis umzugehen ist, abschliessend und für alle gleich nachvollziehbar beantwortet werden kann. Da jedoch zuerst und vor allem die Konsumentinnen und Konsumenten Betroffene sind und ein Verbot damit hauptsächlich die Privatautonomie betrifft, reicht ein Verweis auf die Gesundheitsgefährdung nicht aus. Eine solche Argumentation ist insbesondere deshalb fraglich, da mit Alkohol eine psychotrope Substanz, die zu bedeutenden volkswirtschaftlichen Schäden führt, legal erhältlich ist. Mit dem Verweis auf die Geschichte und die kulturelle Bedeutung des Alkohols für unsere Gesellschaft wird nur die vermeintliche Überlegenheit einer Kultur über eine andere transportiert. Denn um die Kultur als Argument anführen zu können, müsste erst nachgewiesen oder zumindest plausibel dargestellt werden, dass unsere Kultur durch die Erfahrungen mit Alkohol besser in der Lage ist, einen verantwortungsvollen Umgang mit diesem Rauschmittel zu vermitteln als mit anderen Rauschmitteln, die ein ähnliches Gefahrenpotenzial bergen. Selbstverständlich wäre es wünschenswert, wenn die Vorteile eines regulierten, legalen Marktes - unter anderem die Möglichkeit, Steuern zu erheben - auch für diesen Bereich nutzbar wären. Dies ist zwar ausgeschlossen, insbesondere der Jugendschutz sollte bei der Einführung einer Ordnungsbusse aber gestärkt werden, beispielsweise durch eine schärfere Sanktionierung, wenn Cannabis an Minderjährige abgegeben wird als an Erwachsene. Die Vorverurteilung von Cannabis hat auch dazu geführt, dass allein die berauschende Wirkung von Cannabis im Vordergrund stand. Während insbesondere bei Opiaten die medizinischen Nutzungsmöglichkeiten unbestritten sind, steckt die medizinische Forschung bezüglich Cannabis noch in den Kinder-schuhen. Wie hoch das Potenzial tatsächlich ist, wird sich noch zeigen müssen. Doch ein Verbot oder hohe Hürden sind vor allem in jenen Fällen schwer nachvollziehbar, wenn negative Wirkungen zu vernachlässigen sind, wie in der Palliativpflege. Jede Schmerzlinderung dürfte willkommen sein. Und diese zu verwehren, kann nicht im Interesse der Gesellschaft liegen. Es gibt zwar die Möglichkeit für Ärzte, ein Cannabisprodukt als Schmerzmittel zu verschreiben, die administrativen Hürden sind aber enorm. So müssen Anmeldungen beim Amt für Gesundheit in Liechtenstein, aber auch beim schweizerischen Bundesamt für Gesundheit gemacht werden mit einer sehr ausführlichen Begründung. Danach kann das Präparat in einer definierten Apotheke in der Schweiz bestellt werden. Nebst der Reduktion der administrativen Hindernisse dürfte es auch im Interesse der Gesellschaft liegen, das Potenzial von Cannabis zu erforschen und entsprechend bestehende Forschungsbarrieren abzubauen. Ob Liechtenstein über den nötigen Hintergrund verfügt als Forschungsstandort zu fungieren, dürfte bezweifelt werden, da andere Wirtschaftsregionen über mehr Erfahrung im Bereich medizinische Forschung verfügen. Die Interpellanten möchten diese Möglichkeit aber nicht von vornherein verwerfen. Die liechtensteinische Drogenpolitik ist glücklicherweise weit von einem Krieg gegen Drogen entfernt, der sich als Krieg herausgestellt hat, der nicht zu gewinnen ist und der wohl hauptsächlich Opfer produziert hat. Es scheint aber an der Zeit, zu prüfen, ob möglicherweise unter dem internationalen Eindruck auch in Liechtenstein eine Politik verfolgt wurde, die sich zu sehr auf Repression konzentriert und dabei einseitig bestimmte Rauschmittel relativ willkürlich bevorzugt. Selbstverständlich gilt es, diesen internationalen Trend einer liberaleren Haltung einer kritischen Prüfung zu unterziehen und nicht einfach nachzuvollziehen. Aus Sicht der Interpellanten ist es aber lohnenswert, sich diesen Fragen zu stellen. Besten Dank. Landtagspräsident Albert Frick
